NOTICE OF A PUBLIC HEARING
OF THE CITY COUNCIL OF THE CITY OF PORT ARTHUR
otice is hereby given in accordance with the Texas Local Government
Code, Chapter 211 and the Zoning Ordinance of the City of Port Arthur
that the Port Arthur City Council will hold a Public Hearing on Tuesday,
June 16, 2009 at 9:00 a.m. in the Port Arthur City Hall Council Chamber, 444
Fourth Street, to consider the following:
PROPOSED CHANGE: From Single Family Residential (SF) to Light
Commercial (LC)
LEGAL DESCRIPTION; A 6.5479 Acres of the 9.396 Acres of land
labeled Lot 11, Block 1 and Block 12, of the Port
Acres Addition, Port Arthur, Jefferson County,

LOCATION: Located on the corner of F.M. Highway 365 and

Re: Z09-01 Lot change from "SF" (single-family) to "LC" (light -commercial)
REQUEST:
The applicant -Mr. Richard Daley is requesting that a portion the property aka Lot 11,
Blocks 1 and 12 of Port Acres Addition be rezoned from "SF" (Single Family) to "LC"
(Light Commercial) for associated commercial uses. The address for proposed
ordinance 6004 is 6555 Jade Avenue. It is located south of SH 365 (Nome Port
Neches Highway) and west of Jade Avenue AKA Avenue B (See Exhibit).
BACKGROUND:
The applicant proposes to use the land for a grocery store and storage facility. The
business lots will require platting. The grocery store will be in accordance with City's
Building and Health Codes to obtain a (CO) certificate of occupancy.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
The Planning and Zoning Commission recommended (6:1) approval of Z09-01 on
April 6, 2009 for a grocery store and a proposed storage facility. The approval was
with the promise of a neighborhood grocery store and related uses on 6.5479 acres
of the 9.396 acres of land. Resolution 09-176 requested a public hearing for this
case by City Council on the morning of June 16~h 2009

RECOMIVVIENDATION:
The Planning Commission approved the case with an understanding of :-
- A grocery store or neighborhood retail facility built, that will generate
sales tax as well as for related uses, but not just a storage facility.
BUDGETARY/FISCAL EFFECT: None
STAFFING/EMPLOYEE EFFECT: None
SUNIlI4ARY:
The public hearing will allow for a decision for the owner to operate the proposed
businesses as well as the zoning change approval from "SF" (single -family) to "LC"
(light commercial). These uses will be in accordance with the updated Schedule of
Use Chart January 2009
