A RESOLUTION GRANTING AN
PERTAINS TO 848 HOIISTON
CONSTRUCTION OF A FACILITY
WHEREAS, per Resolution No. 08
extension to Westward Properties, LLC,
Houston Avenue and the construction

Properties, LLC or an affiliated company, would maintain the
property, as approved by City Council from the date that the
release of lien is signed; and
WHEREAS, due to current economic conditions, Westward
Properties, LLC is asking for an extension from the original
extension that they were granted of another year, per the document
attached hereto as Exhibit "A"; and
WHEREAS, it is deemed in the best interests of the City to
grant Westward Properties, LLC, or an affiliated company, an
extension until June 4, 2010.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble
are true and correct.
Section 2. That Westward Properties, LLC, or an affiliated
company, is granted an extension until June 4, 2010 as to the
construction of a facility (office and storage building) at 848
Houston Avenue of at least an appraised value of $150,000 or have
construction costs of over $150,000, and that Westward Property,
LLC, or an affiliated company, will maintain the property as to not
cause the City to expend any monies thereon.
Section 3. That a copy of the caption of this Resolution
be spread upon the Minutes of the City Council.
READ, ADOPTED AND APPROVED on this day of

Subject: 848 Houston Avenue
1 am the sole member of Westward Properties, LLC, which bought this property approximately one year ago. The
City Council waived a lien on the property, with the consideration that Westward would build a facility on this
property within a year.
Building such a facility is certainly still our objective. This facility is for the primary purpose of serving the needs of
the refinery expansions, most importantly Motiva, going on in your city. As you are well aware, that expansion
has been drastically slowed due to current economic conditions. We were on the verge of bidding a very large
contract for this expansion in December of last year, and the announcement of their cut-backs was announced
just before the release of that bid!
So as you can imagine we, like many other contractors, are just waiting for things to get back on track. That
being said, I would like to request that the Council vote to extend the time frame for construction of this facility
from one year from the purchase date to two years from the purchase date.
