A RESOLUTION AUTHORIZING A WORK ACTIVITY AGREEMENT WITH WORKFORCE SOLUTIONS OF SOUTHEAST TEXAS (POWERZONE) FOR 2009 SUMMER COMMUNITY PROJECTS PROGRAM - "ONE BLOCK AT A TIME" WHEREAS, the City Council has established "Quality of Life" as a top governance priority; and, WHEREAS, in keeping with this priority it has established the "One Block at a Time" Program as a partnership with citizens to clean, beautify, and improve Port Arthur -one block at a time; and, WHEREAS, the Workforce Solutions of Southeast Texas (PowerZone) is offering a Summer Community Projects Program entitled "Grow Your Own Destiny° (GOOD) to enrich, enhance and educate youth and allow them to contribute to their community's quality of life; and, WHEREAS, the City Council supports the goal of having youth invest in their community. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and COReCt. Section 2. That the City Manager and the Director of Human Resources are hereby authorized to sign all documents necessary, inGuding the Work Activity Agreement attached hereto as Exhibit "A", to facilitate youth employment in partnership with Workforce Solutions of Southeast Texas (PowerZone). Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. P.R. This Agreement is solely between Texas Workforce Solutions Center and the Worksite. The Southeast Texas Workforce Development Boazd, Texas Workforce Commission and the Department of Labor aze not parties to this Agreement. The Agreement must be completed and approved prior to the placement of a participant for a work activity position. The Worksite must comply with applicable, federal, state and labor laws and regulations. The Workforce Solutions Southeast Texas /Power Zone will administer this Work Activity with funds provided through the Workforce Investment Act of 1998 (WIA Adult, Dislocated, and Youth), and/or the Temporary Assistance for Needy Families (TANF) programs. This Agreement is to provide work activities for participants by the Worksite. A description of duties to be performed and/or learned by the participants is detailed on the attached Training Plan. This Agreement is for the period beginning on _ _ _and ending on September 30.2009 Neither party to the Agreement may charge a participant a fee for the referral or placement of the participant under the Agreement. The worksite is subject to on-site monitoring by Workforce Solutions Southeast Texas/PowerZone Representatives, the Southeast Texas Workforce Development Boazd staff, the Texas Workforce Commission, and/or the Department of Labor or other federal funding sowce. 1. The Worksite agrees to: Provide meaningful work experience and adequate supervision at all times; Provide safe working conditions; Asswe that the placement of the participant on the worksite does not result in the displacement of any currently employed worker (including partial displacement such as, reduction in the hows ofnon-overtime work, wages, or employment benefits); BSU 001 Page 1 03/2009 • Insure that the work of participants is performed within the Child Labor Laws if participants aze under the age of 18; • Promptly report to the Workforce Solutions Southeast Texas/PowerZ,one any injuries sustained by participants while on the Worksite; • Maintain appropriate records; submit time sheets and other pertinent information as necessary; • Cooperate fully with the Workforce Solutions Southeast Texas/PowerZone Representative assigned to the Worksite in respect to resolve any conflicts that may arise; • .Assure that all work performed by participants is within the scope of their written training outline; • Assure that participants will not be paid for any holidays, sick leave, or time off, or for time not worked; • Assure that sufficient work is available to occupy the participants during work hours; • Assure that the Worksite will have sufficient equipment and/or materials to do the job; • Notify the Workforce Solutions Southeast Texas/PowerZone immediately if the Worksite no longer desires to work with a client; • Assure that each participant must sign their time sheets; • Assure that each participant will receive at least one break daily for a six (6) hour day; • Comply fully with the Nondiscrimination and Equal Opportunity provisions of the Workforce Investment Act (WIA) of 1998, the Nontraditional Employment for Women Act of 1991; the Disabilities Act of 1990; Title VI of the Civil Rights Act of 1964, as amended; Section 504 of the Rehabilitation Act of 1973, as amended; the Drug-Free Workplace Act of 1998 and with all applicable requirements imposed by or pursuant to regulations implementing those laws; • Assures that the business, branch, division or department of the business does not and will not knowingly employ an undocumented worker as defined in Texas Government Code, 2264.001(4), and • Provide each supervisor involved with the Work Experience program with a copy of this agreement and all applicable attachments. II. The Workforce Solutions Southeast Texas /PowerZone agrees to: • Process employees time sheets for payment (if applicable); • Prepaze and issue checks for participants (if applicable); • Ensure Workmen's Compensation Insurance is provided to participants; • Provide necessary technical assistance to insure compliance with this agreement; • Provide counseling and other related services on an as needed basis to participants; and • Place and/or remove employees from the Worksite upon consultation with the Worksite Supervisor. III. This agreement can be terminated for any of the fallowing reasons: • A 30 day written request by either the Workforce Solutions Southeast Texas /Power Zone or the Worksite Repres • Failure to comply with the terms of this agreement by either party; • Failure to take corrective action; or • Unsafe or unsanitary working conditions. By signing this agreement, I attest that I am an authorized official representing my respective party and will abide by the terms of this agreement.
