Introduction:
This agenda item intends to seek City Council's ratification for the City Manager's emergency
authorization of a contract with SCS Engineers of Bedford, Texas, in the amount of$53,800.00
for the survey of the existing wells and gas probes, monitoring well and gas probe repairs, and
well plug and abandonment at the Landfill.
Background:
An emergency contract is required to survey and repair the monitoring wells and gas probes and
to plug and abandon a well at the Landfill. These deficiencies were found during a Texas
Commission on Environmental Quality (TCEQ) site inspection on December 21, 2021, and
noted in a notice of violation received on February 28, 2022. The notice of violation requires
immediate deficiency corrections to prevent the potential migration of hazardous constituents
from the exposed bore wells and protect human health and the environment.
Budget Impact:
The total cost is $53,800.00 for the emergency repairs and surveying, and funding is available
in the Landfill Professional Services Account, account number 403-50-320-5420-00-00-000.

Recommendation:
It is recommended that the City Council approve P.R. 22434, which ratifies the emergency
authorization of a contract to survey the existing wells and gas probes, monitor well and gas
probe repairs, and plug and abandon a well at the Landfill.

RESOLUTION NO.
A RESOLUTION REQUESTING RATIFICATION OF THE REPAIR AND
UPGRADE OF THE MONITORING WELL AND GAS PROBES AT THE
LANDFILL BY SCS ENGINEERS OF BEDFORD, TEXAS, WITH A
BUDGETARY IMPACT OF $53,800.00. FUNDING IS AVAILABLE IN
ACCOUNT NO. 403-50-320-5420-00-00-000 (PROFESSIONAL SERVICES).
WHEREAS, the Texas Commission on Environmental Quality(TCEQ)performed a site
inspection in December 2021 at the Landfill; and,
WHEREAS, the TCEQ's subsequent findings report, received February 28, 2022, noted
deficiencies with the monitoring well and gas probes whose immediate repair can prevent the
potential for the migration of hazardous constituents from the exposed bore wells and protect human
and environmental health(see Exhibit A); and,
WHEREAS, the compliance due date is March 21, 2022; and
WHEREAS,the mission of TCEQ is to protect the state's public health. Pursuant to Section
252.022(a)(2)this expenditure is authorized to preserve or protect the public health or safety of the
municipality's residents; and,
WHEREAS, SCS Engineers of Bedford, Texas, has begun the repair and upgrade of the
monitoring well and gas probes under emergency conditions authorized by the City Manager and
noted in Exhibit B; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT, in order to protect the health and safety of our citizens and employees, the City
Council hereby approves and ratifies the expenses of the emergency repair and upgrade of the
monitoring well and gas probes at the Landfill with a budgetary impact of$53,800.00 as indicated in
the proposal set forth in Exhibit C; and,

On December 21, 2021,Ms.Emily Bourg of the Texas Commission on Environmental Quality
(TCEQ)Beaumont Region Office conducted an investigation of the above-referenced regulated
entity to evaluate compliance with applicable requirements for municipal solid waste. Enclosed
is a summary which lists the investigation findings.During the investigation, a certain
outstanding alleged violation was identified for which compliance documentation is required.
Please submit to this office by March 21, 2022, a written description of corrective action taken
and the required documentation demonstrating that compliance has been achieved for the
outstanding alleged violation.
In the listing of the alleged violation,we have cited applicable requirements,including TCEQ
rules.Please note that both the rules themselves and the agency brochure entitled Obtaining
TCEQ Rules(GI-032)are located on our agency website at httn://www.tcea.texas.gov for your

30 TAC 330.371(j) states that all monitoring probes and on-site structures shall be sampled
for methane during the monitoring period. Sampling for specified trace gases may be required
by the executive director when there is a possibility of acute or chronic exposure due to
carcinogenic or toxic compounds.
On December 21, 2021, two buildings not noted in the permit were documented onsite. The
buildings did not have continuous monitors and were not documented in any of the submitted
quarterly methane monitoring reports.
Recommended Corrective Action: Please send documentation showing that the alleged
violation has been resolved.

Section 3.2.1 of the Landfill Gas Management Plan of Permit 1815A states that if any
enclosed structures are placed within the permit boundaries, a continuous monitor will be
installed.

gas management plan in the Site Development Plan of Permit 1815A.
30 TAC 330.121(a) states that the approved site development plan, the site operating plan,
the final closure plan, the post-closure maintenance plan, the landfill gas management plan,
and all other documents and plans required by this chapter shall become operational
requirements and shall be considered a part of the operating record of the facility. Any
deviation from the permit and incorporated plans or other related documents associated with
the permit is a violation of this chapter.

Section 3.1.2 states that each time LFG monitoring is conducted, the integrity of the LFG
monitoring probes will be inspected by the sampler... The sampler will perform the following
at each monitoring event:
-Verify that the LFG monitoring probe is clearly labeled on the outer casing or lid.
-Verify that the protective casing is intact and is not bent or excessively corroded
-Verify that the concrete pad is intact(no evidence of cracking or heaving).
-Verify that the padlock is functional.

Failure to maintain gas probes as specified per Sections 3.1.4 of the landfill gas management
plan in the Site Development Plan of Permit 1815A.

On December 21, 2021, investigators conducted a site assessment that included a survey of
the condition of the GMPs. The condition of the GMPs is noted below:
- GP-4 was noted to be heavily corroded with no ability to be properly secured (Photograph
6-9).
- GP-3 was noted to be submerged in approximately one foot of water over the concrete
pad (Photograph 13-17).
- GP-2's concrete pad was noted to have begun to heave on one side (Photographs 19-
23).
- GP-7 was noted to be unlabeled (Photograph 34-35).
Recommended Corrective Action: Please send documentation showing that the alleged
violation has been resolved.

30 TAC 330.371(k)(1) states that monitoring frequency shall be determined as follows.
(1)As a minimum, quarterly monitoring is required. The executive director may require more
frequent monitoring based upon the factors listed in this section. When more frequent
monitoring is necessary, the executive director shall notify the owner or operator.
It was noted during the facility record review that no gas monitoring records were included for
the first quarter of 2020. When additional information was requested, it was stated that
monitoring had not occurred during the October through December quarter. Quarterly
monitoring resumed on February 1, 2021, during the following quarter. It was also noted that
during the September 9, 2020, monitoring event that sampling was not conducted for GP-7.

Dear Jorge:
SCS Engineers (SCS) is presenting this scope of services for repairing and upgrading the monitoring
well and gas probes at the City of Port Arthur Landfill. The scope of work also includes surveying the
monitoring wells and gas probes after the repairs are completed.
The Texas Commission on Environmental Quality (TCEQ) completed a site inspection during the
December 2021 landfill gas monitoring event. As a result of the inspection, deficiencies were noted
for several wells. A previous site visit by SCS identified other areas associated with several wells and
gas probes that might be identified by the TCEQ as areas concern should another inspection occur.
The scope of work includes, but is not limited to, the repair/replacement of various bollards, well
casings and well/probe pads due to erosion or uneven settling of the ground. Several of the pads will
require work to bring them into regulatory compliance. In addition, all the bollards and well casings
will be painted and brass monuments and well identification tags will be placed/replaced on all wells
and probes. The items to be addressed for each well or probe are noted on Task 1.
SCOPE OF WORK
Task 1 —Monitoring Well and Gas Probe Repairs, Well Plug and Abandonment

An unidentified well was noted in the area of where MW-2 was previously located. The well is in
disrepair and SCS recommends the well be plugged and abandoned. SCS assumes that the
materials/debris generated during the well and gas probe activities can be disposed of at the landfill.
Task 2 —Survey Wells and Gas Probes Pads and Casings
Several of the well/gas probe pads will need to be reconfigured or repaired. In addition,the installation
of the brass monuments in the well/gas probe pads and adjustments to well casing heights will require
surveying to meet regulatory requirements.
SCS will contract with a licensed surveyor to survey to survey the brass monuments and any well casing
in which the casing elevation changes. The elevations will be configured to match the current site
elevation datum.
FEES
Project fees are detailed in in the following table. Billing will be conducted on a lump sum, monthly
percent complete basis.
