RE: A Resolution Approving a Property Damage Settlement in the Amount of$32,450 for
Damages to City of Port Arthur Fire Department Unit#2223
Nature of the request:
On January 23, 2022, City of Port Arthur employee was involved in an accident in the intersection of Lewis
Drive and Stadium Road.
Staff Analysis, Consideration:
City has Automobile Physical Damage insurance coverage through Texas Municipal League
Intergovernmental Risk Pool (TML-IRP) with a $2,500 deductible. TML-IRP has offered the City of Port
Arthur a settlement of$32,450 less the $2,500 deductible, making the final settlement offer $29,950 (Exhibit
"A" attached) which is considered a fair and reasonable settlement for Unit#2223. If additional damages are
discovered, TML-IRP may issue a supplemental payment.
Recommendation:
I recommend approval of Proposed Resolution No. 22458 authorizing the property damage settlement
against TML-IRP for damage sustained to Fire Department unit #2223 (2018 Chevrolet Silverado). TML-
IRP has offered to settle the claim for $32,450, less the $2,500 deductible, making the final settlement offer
$29,950. This is considered a fair and reasonable settlement.
Budget Considerations:
The funds received will be deposited in the Insurance Proceeds Account#147-00-000-4744-00-00-000, HR—
Ins Proceeds General FS 001.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER
TO EXECUTE SETTLEMENT OF A PHYSICAL DAMAGE CLAIM
IN THE AMOUNT OF $32,450 MADE AGAINST
TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TML-IRP)
AS A RESULT OF PROPERTY DAMAGE TO FIRE UNIT #2223
WHEREAS, on January 23, 2022, the City of Port Arthur Fire unit, #2223 (2018
Chevrolet Silverado), was damaged when it was involved in a motor vehicle accident,
and;
WHEREAS, as a result of the damage, a claim was filed with Texas Municipal
League Intergovernmental Risk Pool (TML-IRP), and;
WHEREAS, Texas Municipal League Intergovernmental Risk Pool (TML-IRP)
has offered to settle the claim for $32,450 less the physical damage deductible amount
of $2,500, making the final settlement offer $29,950, which is considered a fair and
reasonable settlement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
Section 1. That, the facts and opinions in the preamble are true and correct.
Section 2. That, the City Manager is hereby authorized to execute settlement
in the amount of $32,450, less the physical damage deductible amount of $2,500,
making the final settlement $29,950, which is considered a fair and reasonable
settlement as delineated in "Exhibit A".
