The Port Arthur Zoning Board of Adjustment & Appeals will meet in regular session at
5:30 p.m., Thursday, June 18, 2009, in the City Council Chambers on the fifth floor of
the City Hall. The June 18th agenda contains two applications.
Please make every effort to attend so that we may have a quorum. If for some reason you

I. Roll Call -John Clayton, Hoa "Homie" Dinh, Desiree' Edwards, Deral Segler and Lillie William
(alternate) were present to constitute the necessary quorum. Staff Members present: Plannir
Director, Colleen Russell and Administrative Aide, Pamela Langford
II. Appointment of Chairman and Vice Chairman -John Clayton submitted his name forward
Chairman, Vote -All Yeas -motion passed unanimously.
Desiree' Edwards submitted her name forward for Vice Chairman, Vote -All Yeas -motion
passed unanimously.
III. Minutes - Apri12, 2009 -Public Hearing
Deral Segler moved to accept the minutes of Apri12, 2009 as presented; Ms. Edwards
the motion: Vote -All Yeas -- motion passed.
IV. B09-03, B09-04, B09-O5, B09-06 (Public Hearing on each followed by Motion required
each)
A. B09-03 -Linda M. Barnes -Lot 7, Block 288, Port Arthur Land Company, A-53400 (2101 E.
12th Street) Variance for 10-foot deficit in lot width - i.e. lot is currently 50 feet wide
instead of the required 60-foot lot width.
Motion to approve was made by Deral Segler; seconded by Desiree' Edwards: Item
unanimously.
B. B09-04 -Norris Knight, Sr. -Lot 6, Block 234, Port Arthur Land Company, A-053400 (1
E. 10th Street) -Variance for 10-foot deficit in lot width - i.e. lot is currently 50 feet
wide instead of the required 60-foot lot width.
Motion to approve was made by Desiree' Edwards; seconded by Lillie Williams: Item
approved unanimously.
C. B09-05 -Herman Anderson, Jr. -Lot 1, Block 211, Port Arthur Land Company, A-05340(
(1948 E. 8th Street) -Variance for 10-foot deficit in lot width - i.e. lot is currently 50
wide instead of the required 60-foot lot width.
Motion to approve was made by Deral Segler; seconded by Lillie Williams: Item
approved unanimously.
D. B09-06 -Mary J. Alexander -Lot 1, Block 56, Port Arthur Land Company, A-053400 (13~
10th Street) -Variance for 10-foot deficit in lot width - i.e. lot is currently 50 feet wi
instead of the required 60-foot lot width.
Motion to approve was made by Desiree' Edwards; seconded by Deral Segler: Item
approved unanimously.
V. Report from Director - Ms. Russell informed the Commission that there has been a lot more
construction due to insurance settlements and Rita funds being allocated. Because lots are nc
up to size, individuals are required to go through the legal process and request a variance
through the City. Also, informed Commissioners of an additional alternate being appointed tc
the ZBA.
VI. Future Agenda Items -- Planning Department expects to receive 5 or 6 additional applicatio
requiring variances.

BACKGROUND:
The Board of Adjustment is being asked to consider a variance for the following
lot(s)/tract(s) in the City of Port Arthur, Jefferson County, Texas.
VARIANCES WILL BE ON THE FOLLOWING LOT:

TEXAS AVENUE
This site is located east of Texas Avenue and north of West 17`'' Street (across from Lamar
School). It is also known as Lot 7, Block 15, A-053460 from the Port Arthur Land
Company, Port Arthur, TX 77640-3268. The zoning is "SF" Single-Family housing. Notices
were sent out in compliance with the Texas Local Government Code Section 211 as well as
the publication being done on June 2"d, for the June 18`" meeting more than 15 days prior to
the public hearing.
Applicant- Nick Leiseth Owner- Bessie Lawrence
RECOMMENDATION:
Staff has no objections to this request due to the hardship of the family not being able to
afford more land, yet desiring to have a larger house with 3 bedrooms and in line with City
Codes. The adjacent property owners do not desire to sell.
BUDGETARY/FISCAL EFFECT:

STAFFING/EMPLOYEE EFFECT:

SUMMARY:
The Zoning Board of Adjustment and Appeals is requested to reduce the 5 foot set backs along
Texas Avenue. The City requests no fencing, shrubbery or trees to cause visibility problems.
Hedge shall be 2 feet or less. Other lots with similar situations that will not meet the Code
due to insufficient side setbacks, non conformance with the Subdivision/Zoning Ordinances
shall be similarly viewed. Nevertheless, a legal request is being made prior to the
redevelopment of the lot with athree-bedroom--house having two bathrooms.
