Introduction: The intent of this Agenda Item is to authorize the City Manager to accept the proposal submitted by Construction Managers of Southeast Texas, LLC for the installation of a new awning and repairs made to the Police Department. Background: The awning located at the back of the Police Department sustained severe damage during TS Laura. The awning was attached to the bricks along the back of the Police Department and also had the rain gutters attached to the awning. It is the desire of the Police Department to replace the awning and make repairs to the building. Construction Managers of Southeast Texas, LLC,has submitted a proposal for the repairs in the amount of$24,850.00. Construction Managers of Southeast Texas, LLC, is a participant in the Interlocal Purchasing System (TIPS) cooperative under Reference No. 200201, so no other quotes were needed. Budget Impact: Funds for this purchase are available in account number 001-17-045-5312-00-30-000 Building Maintenance. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH CONSTRUCTION MANAGERS OF SOUTHEAST TEXAS, LLC THROUGH TIPS COOPERATIVE PURCHASING PROGRAM REFERENCE NO. 200201 TO MAKE REPAIRS TO THE AWNINGS FOR THE BACK LOT OF THE POLICE DEPARTMENT IN THE AMOUNT OF $24, 850 . 00 . FUNDING IS AVAILABLE IN BUILDING MAINTENANCE ACCOUNT NO. 001-17-045-5312-00-30-000 . WHEREAS, Chapter 271 of the Texas Government Code allows a city, by resolution of its governing body, to participate in cooperative purchasing programs, such as TIPS Cooperative Purchasing Program, as an alternative to formal bid process ; and WHEREAS, pursuant to Resolution No. 12-008 , the City of Port Arthur entered into an interlocal agreement for cooperative purchasing with Region VIII Education Service Center for participation in the Interlocal Purchasing System (TIPS) ; and WHEREAS, Construction Managers of Southeast Texas, LLC, is an approved vendor through the TIPS Cooperative Purchasing Program under Reference NO. 200201; and WHEREAS, Construction Managers of Southeast Texas, LLC has provided a quote for the installation of two awnings above the rear back doors of the Police Department and repairs to the building which were damaged during tropical storm Laura in the amount of $24 , 850 . 00 , under TIPS Reference No. 200201 attached as Exhibit A; and WHEREAS, funds for this purchase are available in Account No. 001-17-045-5312-00-30-000 Building Maintenance Account . NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct . Section 2 . That the City Council hereby authorizes the City Manager to enter into an agreement with Construction P.R. No. 22471 JLH 3/24/2022 Managers of Southeast Texas, LLC for the installation of the awning and repairs made to the Police Department in the amount of $24 , 850 . 00 under TIPS Reference No. 200201, in substantially the same form as Exhibit "B" . Pricing includes the following items: • Installation of two awning above door ways (approx.. 9'X5') • Install canopy over smoking area at table (approx. 11'X30') • All canopy post to be 4x4 galvanized anchored into concrete • All 4"c-channel galvanized • All 4"closed c-channel galvanized • All galvalume roof panels • All metal flashing galvalume • Remove existing flashing, repair holes in brick, reset damaged brick and paint to match existing as close as possible • Remove area of brick masonry that pulled out from wall • Re-use all bricks that can be saved or replace with new brick as needed • Patch all holes in brick walls with mortar • Re-point mortar joints after flashing has been removed • Install new gutters and downspouts —stainless steel—match existing profile in size and will tie into existing gutters. • Repair bent refrigerant lines Cost for scope identified above: $24,850.00 If you have any questions,please feel free to give me a call. No. 22471 JLH 3/24/2022 EXHIBIT "B" CONTRACT FOR POLICE DEPARTMENT INSTALLATION OF AWNINGS AND REPAIRS THIS AGREEMENT, made this day of , 2022, by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY" and Construction Managers of Southeast Texas, LLC of Port Arthur, Texas hereinafter called "CONTRACTOR" WITNESSETH: That for and in consideration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. The term of this Agreement shall be for 45 days from the date stated on the Notice to Proceed, unless sooner terminated under the provision hereof. The City can terminate this contract at its convenience which includes, but is not limited to, funding not being available in any budget cycle with thirty (30) days written notice. 2. The Contractor will perform work as stated in the Contract Documents. 3. During the term of this Contract, the Contractor will furnish at his own expense all of the materials, supplies, tools, equipment, labor and other services necessary to connection therewith, excepting those supplies specifically not required of Contractor in the Specifications. 4. The CONTRACTOR agrees to perform all the work described in the quote and contract documents and to comply with the terms therein for the amount of $24,850.00. 5.
