Williams, Director of Human Resources RE: A Resolution Approving a Property Damage Settlement in the Amount of$25,000 for Damages to City of Port Arthur Public Works Truck#2270 Nature of the request: On November 12, 2021, Public Works Streets Unit #2270 (Ford F250), was damaged when the driver was misjudged the road and slid into a ditch. Staff Analysis, Considerations: The City has Automobile Physical Damage insurance coverage through Texas Municipal League Intergovernmental Risk Pool Intergovernmental Risk Pool (TML-IRP) with a $2,500 deductible. TML-IRP has offered the City of Port Arthur a settlement of$25,000, less the $2,500 deductible and the salvage retention fee in the amount of $5,000, making the final settlement offer $17,500 (Exhibit "A" attached). This amount is sufficient to cover all estimated property damages for Vehicle #2270. If additional damages are discovered, TML-IRP may issue a supplemental payment. Recommendation: I recommend approval of Proposed Resolution No. 22489 authorizing the property damage settlement against TML-IRP for damage sustained to Streets Vehicle #2270 (2019 Ford F250). TML has offered to settle the claim for $25,000, less the $2,500 deductible and the salvage retention fee in the amount of$5,000, making the final settlement offer $17,500. This is considered a fair and reasonable settlement. Budget Considerations: The funds received will be deposited in the HR Insurance Proceeds Account#001-00-000-4744-00-00-000, HINGF. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE SETTLEMENT OF AN AUTOMOBILE PHYSICAL DAMAGE CLAIM IN THE AMOUNT OF $25,000 MADE AGAINST TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TMLIRP) AS A RESULT OF PROPERTY DAMAGE TO STREET UNIT #2270 WHEREAS, on November 12, 2021 , Public Works Streets Unit #2270 (2019 Ford F250) was damaged when the driver misjudged the edge of the road and slid into a ditch; and, WHEREAS, as a result of the damage, a claim was filed with Texas Municipal League Intergovernmental Risk Pool (TMLIRP); and, WHEREAS, TMLIRP has offered to settle the claim for $25,000, less the Automobile Physical Damage deductible amount of $2,500.00 and the salvage retention fee in the amount of $5,000, making the final settlement offer $17,500, which is considered a fair and reasonable settlement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1 . That, the facts and opinions in the preamble are true and correct. Section 2. That, the City Manager is hereby authorized to execute settlement in the amount of $25,000, less the Automobile Physical Damage deductible amount of $2,500.00 and salvage retention fee in the amount of $5,000, making the final settlement P.R.
