R. #15342 - Chg of Scope for Arceneaux & Gates for CWSRF TWDB Projects DATE 24 June 2009 RECOMMENDATION: I recommend that the City Council approve Proposed Resolution No. 15342, revising the scope of the contract with Arceneaux & Gates Consulting Engineers, Inc. to include construction phase services for the Sanitary Sewer Rehabilitation - CWSRF TWDB Projects, increasing the budget for these services by $852,000 to a total of $1,217,000 and increasing the contract term by 580 days to 730 days. BACKGROUND: In Resolution 09-238, the City entered into a contract with Arceneaux & Gates Consulting Engineers, Inc. (Arceneaux) for the engineering design services for sanitary rehabilitation that we expect to be funded by a Texas Water Development Board Clean Water State Revolving Fund grant from the American Reinvestment and Recovery Act (ARRA). Due to their expertise and familiarity with the projects, we wish to increase the scope ofArceneaux's contract to include Construction Phase Services. Arceneaux has proposed to do the additional work for an amount of $852,000, bringing the contract to a total of $1,217,000. The term of the contract also needs to be increased to include the construction period - a total of 730 days. BUDGETARY/FISCAL EFFECT: Funding is available in Project 426016, 426-1625-532.54-00. EMPLOYEE/STAFF EFFECT: None. SUMMARY I recommend that the City Council approve Proposed Resolution No. 15342, authorizing the City Manager to execute Change of Scope No. 1, revising the scope of the contract with Arceneaux & Gates Consulting Engineers, Inc. to include construction phase services for the Sanitary Sewer Rehabilitation - CWSRF TWDB Projects, increasing the budget for these services by $852,000 to a total of $1,217,000 and increasing the contract term by 580 days to 730 days. A RESOLUTION AUTHORIZING ADDITIONAL SERVICES FOR THE CONTRACT APPROVED TUNE 2, 2009 BETWEEN THE CITY OF PORT ARTHUR AND ARCENEAUX & GATES CONSULTING ENGINEERS, INC. OF PORT ARTHUR, TEXAS FOR PROFESSIONAL SERVICES RELATED TO THE TWDB CWSRF (ARRA) GRANT INCREASING THE BUDGET FOR THIS ENGINEERING SERVICE BY $852,000 TO A TOTAL OF $1,217,000. ACCOUNT 426-1625- 532.54-00, PROJECT 426016. WHEREAS, on June 2, 2009, the City Council of the City of Port Arthur authorized a contract with Arceneaux & Gates Consulting Engineers of Port Arthur, Texas for professional services related to basic design services in the not-to-exceed amount of $365,000; and, WHEREAS, the Texas Water Development Board has allocated $15,075,000 for sanitary sewer projects, pending completion of plans, specifications, permitting, etc. for these projects; and, WHEREAS, due to the scope and time frame required for these projects, hiring an engineering firm for Construction Phase Services is required; and, WHEREAS, Arceneaux & Gates Consulting Engineers, Inc. is most familiar with these projects and is the most qualified engineer to provide this service; and, WHEREAS, Arceneaux & Gates Consulting Engineers, Inc. has submitted a proposal for professional services during the Construction Phase in the not-to-exceed amount of $852,000 (see Exhibit "A'~; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: P.R. No. 15342 Page 2 THAT, the facts and opinions in the preamble are true and correct; and, THAT, revising the scope of services to include Construction Phase Services, increasing the budget for engineering design and construction phase services by $852,000 to a total of $1,217,000 (Project 426016, 426-1625-532.54-00,), and increasing the total contract term to 730 days is herein approved. City Manager is authorized to execute said Change of Scope as attached in Exhibit "B"; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. We have discussed the need to assist the City with professional services during the Construction Phase and preparing information for Grant-in-Aid Application relating to projects to be funded from the TWDB State Revolving Fund (SRF). We request authorization for Construction Phase Services as outlined in Section A.3. of our Contrail for Professional Services as well as for Additional Services listed under Section B. (6}, (11), (13), (14) and (22). COMPENSATION AND S[HEDULE For these services described above, we propose to be compensated on a reimbursable basis according to the schedule of rates in our contract and will not exceed the sum of Eight Hundred Fifty- two Thousand Dollars ($852,000.00) without your prior written authorization, bringing the total contract amount authorized to $1,217,000.00. We request that the period of service be extended to a total of 730 calendar days from the date of the contract.
