"Bob"Bowers Civic Center To: The Honorable Mayor and City Council Through: Ron Burton, City Manager From: Adam J Saunders, Civic Center Dir RE: Proposed Resolution No. P.R. 22491 REQUEST: The Department Club at 1924 Lakeshore Drive is in need of repair and maintenance. In November of 2021 the Council passed Res 21-459. This Resolution was for Phase III of the repairs and maintenance. In March of 2022 the Council passed Res 22-141. This Resolution was for Change Order#1. It has been determined additional materials and days will be needed for the repairs and maintenance at the Department Club. These materials are for the installation of mosaic tile over the wood floor substrate in order to get the tile setting manufacturer's warranty on the tile floor installation.The contractor found a very springy wood floor substrate during demolition. This material helps prevent cracking of tile and grout after it has been installed.These additional requirements were determined when the tile setting material manufacturer visited the site and informed the contractor and architect the additional materials would now be needed. Sixty days need to be added to the completion of the project due to the delays caused by the need to have two HVAC units installed. There was a major delay in getting the equipment in and installed. The additional material and additional days will be Change Order#2. The cost of this Change Order#2 is $2,537.48. The total amount of Phase III is $295,144.18, which includes this Change Order#2. McInnis Construction, Inc. of Silsbee will perform the work for a cost of$2,537.48. Funds available in account 307-21-049-8512-00-10-000. ANALYSIS/CONSIDERATION: There are a lot of needed repairs at the building. Phase I and II have been performed. Phase III is the next step in the repairs and restoration of the Department Club. Change Order#2 to the Phase III repairs is needed. RECOMMENDATION A resolution authorizing the City Manager to enter into an agreement with McInnis Construction,Inc. of Silsbee for Change Order#2 to Phase III repairs and maintenance of the Department Club in the amount of$2,537.48. OF SILSBEE, TEXAS FOR PHASE III REPAIRS TO THE DEPARTMENT CLUB INCREASING THE CONTRACT BY SIXTY (60) DAYS AND THE AMOUNT BY $2,537.48 TO A NEW TOTAL OF $295,144.18 . FUNDS AVAILABLE IN ACCOUNT 307-21-049-8512-00-10-000 PROJECT NO. BU00111 WHEREAS, the City Council approved Resolution No. 21-459 at the November 9, 2021 Council Meeting, an agreement with McInnis Construction of Silsbee, Texas for Phase III repairs to the Department Club in the amount of$258,500.00; and WHEREAS, the City Council approved Resolution No. 22-141 at the March 29, 2022 Council Meeting, Change Order No. 1 to Phase III repairs to the Department Club in the amount of$34,106.70 to a new total of$292,606.70; and WHEREAS, it has been determined that sixty(60) additional days are needed to the completion of the project due to delays caused by the installation of HVAC equipment; and WHEREAS, during the demolition of floor areas in preparation for Phase III repairs to the Department Club, it was determined additional material was needed to prevent cracking of floor tiles; and WHEREAS, these additional days and repairs will be Change Order No. 2; and WHEREAS, McInnis Construction, Inc. of Silsbee, Texas will do this work for $2,537.48; and WHEREAS, approval of Change Order No. 2 is deemed an appropriate action. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That, the City Manager is hereby authorized to execute Change Order No. 2 with McInnis Construction, Inc of Silsbee,Texas for to Phase III repairs at the Depaihuent Club. Section 3. That, the funding for said agreement is $2,537.48. PO 22491 Section 4. That, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
