HomeMy WebLinkAboutPR 22537: APPROVAL OF TIME-EXTENSION CHANGE ORDER NO. 3 City of (1r! rfllnr INTEROFFICE MEMORANDUM Date: April 29, 2022 To: The Honorable Mayor and City Council Through: Ronald Burton, City Manager From: Calvin Matthews, P.E., Water Utilities Director RE: PR 22537—Approval of Time-Extension Change Order No. 3 Introduction: The intent of this Agenda Item is to seek City Council's approval of Change Order No. Three (3) for the Remediation and Mitigation of the Twelve (12) Harvey Lift Stations as a time- extension change order. The original contract amount was awarded by Resolution No. 21-134 on April 13, 2021 for $1,278,248.00 and 210 days from the start date on the Notice to Proceed. Contract Change Order No. One (1) was a time extension only change order, but due to an oversight, was not processed. Contract Change Order No. Two (2), approved by Resolution No. 22-125, was for a time extension of sixty(60) days. This Change Order No. Three (3) is a time-extension change order of 120 days, which includes the time extension not processed from Change Order No. One (1), making the contract end date June 27, 2022. Background: In April of 2021, the Council passed Resolution No. 21-134, awarding the Remediation and Mitigation of the Twelve (12) Harvey Lift Stations contract to BDS Constructors, LLC DBA MK Constructors of Vidor, Texas. The project is managed by Arceneaux, Wilson& Cole, LLC of Port Arthur, Texas. Budget Impact: The original contract amount was $1,278,248.00; Change Order No. Two (2) was a deductive change order for $10,000.00. This Change Order No. 3 is a time-extension change order,of 120 days with no budget impact. The current contract value is $1,268,248.00. Funds are available in Account No. 405-40-000-8516-00-00-000, Project No. WS0005-CON. Recommendation: It is recommended that City Council adopt Proposed Resolution No. 22537, which extends the duration of the project for 120 days, as discussed/outlined above. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 3 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND BDS CONSTRUCTORS, LLC DBA MK CONSTRUCTORS OF VIDOR, TEXAS FOR THE REMEDIATION AND MITIGATION OF THE TWELVE (12) HARVEY LIFT STATIONS, EXTENDING THE DURATION OF THE PROJECT WITH A TIME EXTENSION OF 120 DAYS; ACCOUNT NO. 405-40-000- 8516-00-00-000, PROJECT NO. WS0005-CON. WHEREAS, pursuant to Resolution No. 21-134, City Council awarded a contract to BDS Constructors, LLC DBA MK Constructors of Vidor, Texas, for the remediation and mitigation of the twelve (12) Harvey lift stations for the amount of$1,278,248.00; and, WHEREAS, Change Order No. One (1) was submitted by Arceneaux, Wilson and Cole, LLC, for a proposed time extension of 60 (sixty) days, but due to an oversight, it was not processed; and, WHEREAS, pursuant to Resolution No. 22-125, City Council approved deductive Change Order No. Two (2) to the Remediation and Mitigation of the Twelve (12) Harvey Lift Stations in the amount of $10,000.00, to a new total of $1,268,248.00, and extending the completion date by 60 days; and, WHEREAS, Arceneaux Wilson & Cole LLC, Project Engineers, has submitted Change Order No. Three (3) (attached hereto as Exhibit "A") to the Remediation and Mitigation of the Twelve (12) Harvey Lift Stations, extending the completion date by 120 days to the project to a new term of 390 days (June 27, 2022) and has no cost impact; and, WHEREAS, Charge Order No. Three (3) will reconcile the previously requested time extension of sixty(60) days in Change Order No. 1 that was not processed; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: PR No. 22537 4/29/22 bw Page 2 of 3 THAT, the facts and opinions in the preamble are true and correct; and, THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to approve Change Order No. Three (3) to the contract with BDS Constructors, LLC DBA MK Constructors of Vidor, Texas, Texas, increasing the duration of the project with a time extension of 120 days due to material changes to a new term of 390 days (June 27, 2022) and has no cost impact, in substantially the same form as attached hereto as Exhibit"A". THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. This change order is for extending the contract time by one hundred twenty(120) calendar days. The electrical subcontractor for the project has informed the Contractor of another additional 8-week delay beyond the last reported and anticipated construction completion timeframe. This delay is due to equipment and material delivery delays beyond the previously anticipated schedule. These materials were necessary for the completion of the electrical control panels for each site. The electrical subcontractor has now received all necessary appurtenances to begin constructing the remaining electrical improvements at each lift station site. The Contractor has completed all construction activities involving new fencing and elevated platforms at the lift station sites. We have just received all of the pieces needed and are going to start installing this week.The control panels have just been completed and we can now install them as well. We needed all components in to begin with gear due to the fact that size is an issue with the platforms. Everything was needed to insure proper fit. Let us know what we can do... Entergy will have to be involved in most of these so we are requesting an additional 60 days.
