Re: P.O.6015 Waiving Building Permit Fees for Housing Authority
RECOMMENDATION: Staff is proposing to amend the current building
pemut fees and waive fees for the Housing Authority new single family housing
project that will be built in CDBG eligible areas of the city and those that are new
market tax credit eligible.
BACKGROUND: The Port .Arthur Housing Authority is planning to build a
number of single family residences in the city. Adoption of this amendment will
assist the Housing Authority in deferring some of the cost associated with their
construction plans for these homes.
BUDGET AND REVENUE IMPACT: No fees assessed for project. Increase
single family housing stock in the city.

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 18 SECTION iS-33 (a) PERMIT
SCHEDULE SECTION B106 EXCEPTIONS TO PERMIT FEES, OF THE
BUILDING CODE OF ORDINANCES OF THE CITY OF PORT ARTHUR;
SAID CHANGES REPEAL ALL OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; AND DECLARING THE EFFECTIVE DATE
HEREOF.
WHEREAS, the City Council of Port Arthur deems it in the best interest of the citizens of
the City of Port Arthur to adopt the amendment to Chapter IS Section 18-33 Permit
Schedule; Section B106 Exceptions to Permit Fee of the Building Code for the City of Port
Arthur and may make variations thereto that that do not substantially vary from the rules or
laws of this State: and
WHEREAS, the City Council of Port Arthur deems it in the best interest of the citizens of
the City of Port Arthur to adopt the proposed amendment to Subsection B106 of Chapter
18 Section 18-33 (a); to waive fees for the Port Arthur Housing Authority single family
housing being built in CDBG eligible areas.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR, TEXAS:
Section 1. That the facts and opinions in the preamble aze true and correct.
Section 2. That Subsection B106 of Section 18-33(a); Exceptions to Permit Fees of the
Code of Ordinance is hereby amended to read as set forth in EXHIBIT "A'".
Section 3. That this being an Ordinance that does not require publication, it shall be
effective immediately.
Section 4.That the caption of this Ordinance shall be spread upon the minutes of the City
Council.

Section B106, Exceptions to the Permit Fee:
U.S. Government;
Federal agencies;
State of Texas;
Jefferson County;
City of Port Arthur;
Public Schools;
Southeast Texas Regional Planning Commission;
Community Housing Programs and sub recipients as it pertains to City Housing
Programs;
Non-Profit Organization performing repairs to Humcane Rita damaged homes;
Any non-profit organization that will be assisting citizens who are unable to repair their
property; the City of Port Arthur will waive all permit fees that are associated with the repair
project.
The Port Arthur Housing Authority's single family housing projects being built in
CDBG eligible areas.
