NO. 22551 — A Resolution amending Resolution No. 22-137 for non-monetary support of the Sabine Pass Port Authority's Grant Application to the Department of Transportation. Introduction: The intent of this Agenda Item is to request approval of Proposed Resolution No. 22551, amending Resolution No. 22-137 providing for non-monetary support of the Sabine Pass Port Authority's application to the Port Infrastructure Development Program (PIDP) grant for up to $11,000,000.00. Background: On March 29, 2022, City Council approved Resolution No. 22-137 supporting the Sabine Pass Port Authority's Application to the United States Department of Transportation for the 2022 Port Infrastructure Development Program (PIDP) Grant (Opportunity #MA-PID-22-001) for $7,100,000.00. More recently, the Port of Sabine Pass was granted the opportunity to increase the amount of grant funding to up to $11 ,000,000.00 to support five (5) proposed projects for Port improvement(s). The Port Infrastructure Development Program (PIDP) is a discretionary grant program administered by the U.S. Maritime Administration. Funds for the PIDP are awarded on a competitive basis to projects that improve the safety, efficiency, or reliability of the movement of goods into, out of, around, or within a port. Congress provided first-year funds of $293 million for the program in the FY2019 Consolidated Appropriations Act. Congress continued funding the program at $225 million in FY2020 and $230 million in FY2021 . For FY2022 the Infrastructure and Jobs Act/Bipartisan Infrastructure Law, appropriated $450 million to the PIDP. "Remember,we are here to serve the Citizens of Port Arthur" P.O. Replacement of approximately 400' of sheet piling wall along the Sabine Neches Water Way on the Sabine Pass Port Authority property that leads to Dustin Gulf Seafood. 2. Replacement of approximately 200' of sheet pilling wall along the Sabine Neches Water Way on the Sabine Pass Port Authority property that provides mooring for commercial vessels that utilize the bulk fueling site. 3. Replacement of approximately 2500' of sheet piling wall along the Sabine Neches Water Way on the Sabine Pass Port Authority property that provides mooring for commercial vessels and add a heavy fendering system. 4. Convert the existing inside the gate Port Authority Road to a two (2) lane heavy industrial road. 5. Stabilize an 11-acre site for material lay down yard and future capital infrastructure projects. A RESOLUTION AMENDING RESOLUTION NO. 22-137 FOR NON- MONETARY SUPPORT OF THE SABINE PASS PORT AUTHORITY'S APPLICATION TO THE DEPARTMENT OF TRANSPORTATION MARITIME ADMINISTRATION FOR THE 2022 PORT INFRASTRUCTURE DEVELOPMENT PROGRAM GRANTS (OPPORTUNITY#MA-PID-22-001) INCREASING THE GRANT AMOUNT FROM $7,100,000.00 UP TO $11,000,000.00. WHEREAS, On March 29, 2022, City Council approved Resolution No. 22-137 providing non-monetary support of the Sabine Pass Port Authority's Application to the Department of Transportation Maritime Administration for the 2022 Port Infrastructure Development Program Grants (Opportunity #MA-PID22-001) for $7,100,000.00; and, WHEREAS, the Sabine Pass Port Authority has been granted the opportunity to increase the request for funding from $7,100,000.00 up to $11,000,000.00; and, WHEREAS, The Port Infrastructure Development Program (PIDP) is a discretionary grant program administered by the U.S. Maritime Administration. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That it is in the best interest of the City of Port Arthur to amend Resolution No. 22-137 supporting the Sabine Pass Port Authority's application to the Department of Transportation Maritime Administration for the 2022 Port Infrastructure Development Program Grants increasing the grant amount from $7,100,000.00 up to $11,000,000 (Exhibit "A"). The Sabine Pass Port Authority is strategically located on the Sabine Neches Waterway and is a key port for the commercial shrimping business, as well as harbor for the multitude of shallow draft vessels that serve the vast industrial complex of Southeast Texas. As the grant application outlines the planned projects for the Sabine Pass Port Authority, it is evident that they are committed to improving the service to their existing customers, as well are planning for diversifying their business to better serve industry and open opportunities for new businesses to engage in commerce on the Sabine Neches Waterway. The grant application submitted by the Sabine Pass Port Authority will demonstrate clearly that the projects that the Port seeks funding for will meet all of the criteria as established by the USDOT Port Infrastructure Development Program. USDOT Port Infrastructure Development Program Merit Criteria: i. Improving safety, efficiency or reliability of the loading and unloading of goods by a. Removing old sheet piling dock wall and tie backs and installing new sheet piling with improved corrosion protection and cargo loading transition points b. Paving port roadways with cement versus the current rocky potholed roadway Each of the projects referenced within improves safety, efficiency, and reliability of Port operations. 2. Addressing climate change and environmental justice impacts by providing a safe, efficient fuel station at a central strategic location on the Sabine Neches Ship Channel that reduces fuel consumption and vessel traffic on the waterway. 3. Supporting economic vitality by securing the current port dock and internal roadway infrastructure will result in improving the capabilities of loading and off-loading of goods and supplies to ensure the economic vitality of the Port and enables Port customers to prosper. 4. Advancing equity and opportunity for all. As the population of the City of Port Arthur is 83.5%non-white and i00%of the commercial shrimping fleet is owned and operated by people of Asian descent, the Port provides direct job opportunities and enables other industries to be successful in their endeavors that otherwise would not have the opportunity to succeed. 5. Leveraging Federal funding to attract non-Federal sources of funds.As the projects funded by the PIDP grant are started and progress to completion, this will empowerthe 1 Port to expand business and require capital investment by the Port. Also, infrastructure such as roadways that provided access to the Port will need to be improved and or modified for the increase in vehicle traffic, which would be funded by State or City investments. The Port is 6 miles from the Gulf of Mexico and 14 miles from the Intracoastal Waterway. The Port is within the city limits of the City of Port Arthur Texas and is in Jefferson County of Texas. The Port was able to rebuild a portion of the Dock in 2014 but due to financial limits was not able to reconstruct the entire dock. However, with the downsizing of the oil&gas drilling industry in the Sabine Pass area, the Port has lost a substantial part of that business revenue. Today, the shrimping industry . is the primary port customer, with dredging companies and ,,; ® the oil-gas industry as our CI'EVRCN :=HL_NS secondary customers. The Port berths 25 commercial shrimping vessels and provides fueling services to the majority of the approximately SARINF PASS .v, loo commercial shrimp vessels r .40 that operate in the Port Arthur SABINE PASS /Sabine Pass/Jefferson • County area. The Port has • partnered with RelaDyne Marine to provide fueling services from the Port docks. This fueling service has dispensed 11,510,868 gallons over the past four years. According to data provided by the Texas A&M AgriLife Extension Service, the shrimping industry continues to be a valued contributor to the local and state economy. "-�- 1111116 am; 6 SECTION 3 Current Operational Identity& Future Plans The Port has invested substantially in capital improvements over the last 3 years.The investments included: • $4,764,000.00/a port extension project that will add an additional i000'of new mooring space when completed in 2023./Will diversify the type of vessels that can moor at the Port with docking space for barges, larger offshore supply vessels and additional commercial shrimping vessels. This will drive growth and increase productivity. • $ S7o,000.00/Fuel dock protection mooring wall/Collaborating with local business RelaDyne Marine Fueling to provide bulk fueling on the Sabine Neches Waterway • $633,847.00/maintenance dredging/this project included the dredging of the channel that houses the Jefferson County Maritime Division that provides security and safety patrols from the Gulf of Mexico to the Port of Beaumont Texas. Total of$5,967,847.00 invested by the Port over a 3 year period, demonstrates that the Port's pledge to a prosperous economy, that is conducive to growth, productivity, innovation and entrepreneurship. The Port also purchased in 2020, 8 acres of undeveloped land that abuts up to the existing Port boundary. The original sheet piling was installed in 198o and is currently in a very deteriorated condition. Due to the unsafe state of the above ground section of the sheet pilings, the Port did construct a wooden cap walkway over the entire 27oo'ofwall. This was just a band aid project to protect employees, workers and contractors from injury as the jagged top of the sheet pilings was very dangerous to work nearby. However,the entire wall needs to be replaced to protect the integrity of the Port operations.
