REQUEST:
Resolution 22-078 was passed by City Council where the City of Port Arthur and the YMCA of Southeast
Texas executed a Memorandum of Understanding(MOU)regarding the operation of the West Side
Development Center(WSDC),which is owned by the City. This MOU obligates the City to provide
grant funds to the YMCA to accomplish daily operations of the WSDC.
Following a public hearing on January 18, 2022 the City Council authorized$80,000.00 from the
American Rescue Plan Act(ARPA)allocation to be paid to the YMCA for this function. This funding is
intended to be used during the calendar year of 2022 from January through December. The YMCA in
receipt of these funds agrees to follow all applicable guidelines as found in the US Treasury Final Rule
for the ARPA funds.
ANALYSIS/CONSIDERATION:
The YMCA of Southeast Texas operates the daily functions of the WSDC. Funding is agreed upon from
the City to the YMCA in the amount of$80,000.00 through the ARPA grant for calendar year 2022. The
YMCA agrees to follow all Federal guidelines stated for use of these funds.
RECOMMENDATION
A resolution authorizing the City Manager to issue a payment to the YMCA of Southeast Texas in the
total amount of$80,000.00 for operations of the West Side Development Center.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO ISSUE A
PAYMENT TO THE YMCA OF SOUTHEAST TEXAS (PORT ARTHUR
BRANCH) IN THE TOTAL AMOUNT OF $80,000.00 FOR THE ANNUAL
OPERATION OF THE WEST SIDE DEVELOPMENT CENTER.FUNDING
IS AVAILABLE FROM THE AMERICAN RESCUE PLAN (ARPA)
ACCOUNT NO. 169-07-015-5470-00-40-000.
WHEREAS,the City of Port Arthur, a political subdivision of the State of Texas owns the
West Side Development Center located at 601 W Rev Dr Ransom Howard St, Port Arthur, TX
77640: and
WHEREAS, per Resolution 22-078 the City of Port Arthur and the YMCA executed a
Memorandum of Understanding regarding the operation of the West Side Development Center:and
WHEREAS,per the Memorandum of Understanding,the City is obligated to provide grant
funds to the YMCA to accomplish the daily operations of the West Side Development Center, and
WHEREAS,following a public hearing on January 18,2022,the City Council authorized an
expenditure of Eighty Thousand Dollars($80,000.00)from the American Rescue Plan Act(ARPA)
allocation under the Loss Revenue Category for Government Operations to be paid to the YMCA of
Southeast Texas (Port Arthur Branch)to support the West Side Development Center; and
WHEREAS,in consideration of the approval of the City Council,the identified funding is
intended to be used during the calendar year of 2022 from January through December in a manner
that allows for continuous operations at the West Side Development Center; and
WHEREAS,the YMCA of Southeast Texas upon receipt of said funds agrees to follow all
applicable guidelines as found in the US Treasury Final Rule for the American Rescue Plan Act
(ARPA) funds as outlined in Exhibit"A".
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
THAT,the facts, and opinions in the preamble are true and correct.
THAT, the City Council of the City of Port Arthur hereby authorizes payment from the
American Rescue Plan Act allocation under the Loss Revenue Category for Government Operations.
THAT, the City Council authorizes the City Manager to sign the agreement attached in
substantially the same form attached hereto as Exhibit"A".
THAT,a copy of the caption of this Resolution shall be spread upon the Minutes of the City
Council.

CONTRACT
American Rescue Plan Act (ARPA) Funds Allocation
PARTIES TO THE CONTRACT
This contract made and entered into by and between the City of Port Arthur, Texas (hereinafter
called the "City") acting herein by its City Manager, duly authorized by Resolution of the City
Council of the City of Port Arthur and " YMCA of Southeast Texas (Port Arthur Branch)",
Jefferson County,Texas(hereinafter called"YMCA")acting herein by its Executive Director,duly
authorized by its Board of Directors. The parties hereto agree, by the execution hereof, that they
are bound to the mutual obligations and to the performance and accomplishment of the tasks
described herein.
RECITALS
Whereas, the City of Port Arthur, a political subdivision of the State of Texas owns the
West Side Development Center located at 601 W Rev Dr Ransom Howard St, Port Arthur, TX
77640; and
Whereas, per Resolution 22-078 the City of Port Arthur and the YMCA executed a
Memorandum of Understanding regarding the operation of the West Side Development Center;
and
Whereas, per the Memorandum of Understanding, the City is obligated to provide grant
funds to the YMCA to accomplish the daily operations of the West Side Development Center; and
Whereas, following a public hearing on January 18, 2022 on the matter, the Port Arthur
City Council authorized an expenditure of Eighty Thousand Dollars ($80,000.00) to support the
West Side Development Center-YMCA of Southeast Texas to be paid from the American Rescue
Plan Act allocation under the Loss Revenue Category for Government Operations, and
Whereas, in consideration of the approval of the City of Port Arthur City Council, the
identified funding is intended to be used during the calendar year of 2022 from January through
December in a manner that allows for continuous operations at the West Side Development Center.

Therefore, be it agreed to the following terms:
That, the YMCA of Southeast Texas (YMCA) shall provide the services as indicated in the
Memorandum of Understanding approved per Resolution 22-078 on February 15, 2022.
That, the YMCA upon receipt of said funds agrees to follow all applicable guidelines as found in
the US Treasury Final Rule for the American Rescue Plan Act(ARPA) funds, and
That, the YMCA agrees to specifically provide the necessary information and documentation to
allow the City to remain compliant with all US Treasury ARPA reporting requirements, and
That, the YMCA agrees that should it fail to provide the necessary supporting documentation as
identified in this agreement or in future written requests from the City Manager or the Director of
the Civic Center Department, and such activity results in a default of the ARPA funding, the
YMCA shall reimburse the City in the amount equal to any funds defaulted, and
That either party may cancel this contract and terminate the pledges herein by providing a written
notice of intent to terminate with a sixty(60)day notice period forwarded to the signatories of this
agreement, and
That any unused funds shall be returned at the time of the date of termination, and
That,the YMCA shall remain bound by all aspects of record keeping and required documentation
to the City as stated in this agreement regardless of a termination of this agreement, and
That, any disputes between the parties in this agreement shall first be referred to the City of Port
Arthur City Manager for resolution, and
That, any unresolved disputes following the intervention of the City Manager shall be open to any
and all appropriate relief available in the County of Jefferson,State of Texas and that the prevailing
party shall be entitled to all associated costs incurred in achieving such resolution.
