NO. 22560 — Proposed Resolution calling for a public hearing for a specific use permit Introduction: The Port Arthur City Council is being asked to approve Proposed Resolution No. 22560, calling for a public hearing to consider granting a specific use permit for approximately 0.7602-acre of land, consisting of Lots 7-12, Block 345, City of Port Arthur Addition (2301 Gulfway Drive), Port Arthur, Jefferson County, Texas. The purpose of the request is to operate a package/liquor store in a Light Commercial (LC) zoned district adjacent to a residentially zoned district. Background: On April 11, 2022, the property owner applied for a specific use permit (SUP) for the operation of a package/liquor store in a Light Commercial District. Per Appendix A, Section 22(28): Special Conditions, a package store approved by specific use permit in the Light Commercial (LC) district shall not be located on a lot or tract of land adjacent to or across the street from a Single-Family (SF) or Two-Family (2F) district unless located in a shopping center of which it comprises not more than 25 percent of the floor area. The proposed package/liquor store will be in a strip center and account for less than 25 percent of floor area for operation; however, the location is adjacent to a single-family zoned district; therefore, requiring a specific use permit for operational purposes. The Planning & Zoning Commission conducted a public hearing on May 16, 2022. Budgetary Impact: None Recommendation: It is recommended that City Council approve P.R. NO. 22560, calling for a public hearing to consider granting a specific use permit for approximately 0.7602-acre of land, consisting of Lots 7-12, Block 345, City of Port Arthur Addition (2301 Gulfway Drive), Port Arthur, Jefferson County, Texas. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER GRANTING A SPECIFIC USE PERMIT FOR APPROXIMATELY 0.7602- ACRE OF LAND CONSISTING OF LOTS 7-12, BLOCK 345, CITY OF PORT ARTHUR ADDITION (2301 GULFWAY DRIVE), PORT ARTHUR, JEFFERSON COUNTY, TEXAS, FOR THE OPERATION OF A PACKAGE STORE Z22-05 (ZANAMAR PROPERTIES, LLC) WHEREAS, it is being requested that City Council consider granting a specific use permit for the area delineated in Exhibit "A"; and, WHEREAS pursuant to Chapter 211 in the Texas Local Government Code, a public hearing must precede any zoning change. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the facts and opinions in the preamble are true and correct. THAT the Planning and Zoning Commission reviewed the case on May 16, 2022. THAT a public hearing to consider whether to grant the specific use permit for approximately 0.7602-acre of land consisting of Lots 7-12, Block 345, City of Port Arthur Addition (2301 Gulfway Drive), Port Arthur, Jefferson County, Texas, as delineated in Exhibit "A" shall be held on June 21, 2022, at 10:00 a.m. in the City Council Chambers, Fifth Floor, City Hall, 444 4th Street, or by telephonic and videoconference. THAT notice of the public hearing shall be published at least fifteen days prior in the City's official newspaper before going to the City Council. THAT a copy of the caption of this Resolution is spread upon the Minutes of the City Council.
