NO. 22561 — Proposed Resolution calling for a public hearing for the abandonment of a portion of alley right-of-way Introduction: The Port Arthur City Council is being asked to approve Proposed Resolution No. 22561 , calling for a public hearing to consider a proposed abandonment for an approximate 0.067-acre (20' x 146') portion of a dedicated alley right-of-way out of Block 474 (between Austin Avenue and Waco Avenue), Port Arthur, Jefferson County, Texas. The purpose of the request is to develop single-family homes in the 500 Block of 17th Street. Background: On or around February 24, 2022, Clarence Wise applied for the proposed abandonment of a portion of alley right-of-way located in Block 474, Port Arthur, Jefferson County, Texas. Per Chapter 94, Article VI, Section 94-382, any person desiring to have a city street, alley, or easement abandoned and vacated shall make an application for the same to the director of planning. The application shall be accompanied by the following: • The signed and acknowledged written consent and release of all owners (including lessees) of all property which abuts on either side of the street, alley, or easement proposed to be abandoned. • The signed and acknowledged written consent and release of all owners (including lessees) of all property to which access would be materially and substantially impaired if the proposed abandonment is granted. • An administrative fee as provided in section 94-381. • Title report issued by a title insurance company acceptable to the city identifying abutting ownership. The requester and his business partner own all real property adjacent to the portion of the alley right-of-way referenced above. The Planning & Zoning Commission conducted a public hearing on May 16, 2022. Budgetary Impact: None Recommendation: It is recommended that City Council approve P.R. NO. 22561, calling for a public hearing to consider a proposed abandonment for an approximate 0.067-acre (20' x 146') portion of a dedicated alley right-of-way out of Block 474 (between Austin Avenue and Waco Avenue), City of Port Arthur, Jefferson County, Texas. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER A PROPOSED ABANDONMENT FOR APPROXIMATELY A 0.067-ACRE (20' X 146') PORTION OF A DEDICATED ALLEY RIGHT-OF-WAY, BLOCK 474 (BETWEEN AUSTIN AVENUE AND WACO AVENUE), PORT ARTHUR, JEFFERSON COUNTY, TEXAS, FOR THE RESIDENTIAL DEVELOPMENT OF SINGLE-FAMILY HOME A22-01 (CLARENCE WISE) WHEREAS, it is being requested that City Council consider granting an abandonment of public right-of-way for the area delineated in Exhibit "A"; and, WHEREAS pursuant to Chapter 94, Article VI, Section 94-383 in the Port Arthur Code of Ordinances, a public hearing shall be held with notice furnished all property owners within 200 feet and published in the official newspaper of the city; and, WHEREAS, the City Council has the authority to vacate, abandon or close a street under Section 311.001 and 311.007 Transportation Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the facts and opinions in the preamble are true and correct. THAT the Planning and Zoning Commission reviewed the case on May 16, 2022. THAT upon abandoning and vacating the alley, the City shall have the right, if it so desires, to retain utility easements. THAT a public hearing to consider whether to grant the applicant the abandonment as delineated in Exhibit "A" shall be held on June 21, 2022, at 10:00 a.m. in the City Council Chambers, Fifth Floor, City Hall, 444 4th Street, or by telephonic and videoconference.
