ABATEMENT AND DEMOLITION OF A DANGEROUS CITY-OWNED BURNED
COMMERCIAL PROPERTY LOCATED AT 723 FREEMAN AVENUE AKA TEXAS
AVENUE/501 W. 7TH STREET.
COMMENT
RECOMMENDATION: Staff recommends that the City Council adopt P. R. No. 22596 ratifying an
emergency contract to Lark Group Inca in the amount of$31,742.00 for the emergency asbestos/lead
abatement and demolition of a City-owned burned commercial property located at 723 Freeman Avenue
aka Texas Avenue/501 W. 7th Street.
BACKGROUND: The City-owned burned commercial structure located at 723 Freeman Avenue aka
Texas Avenue/501 W. 7th Street was in imminent danger of collapse because of the fire,and as a result,
it was necessary to immediately perform emergency asbestos/lead abatement and demolition of the
building per Section 108, Unsafe Structures, of the 2012 International Property Maintenance Code.
Lark Group Inc., was the lowest responsible bidder.
Our Asbestos consultant, Honesty Environmental Services, Inc., secured three (3) emergency quotes for
this work. Lark Group Inc., of Warren, Texas was the lowest, most responsive bidder; their bid
was $31,742.00 (5 days). AAR Incorporated of Houston, Texas bid $41,350.00; and Sitek Omni
Services LLC., of Humble, Texas bid $54,400.00. Bid award is based on the lowest and most
responsive bid.
BUDGET AND REVENUE IMPACT: Acceptance of this recommendation will not require a budget
amendment. Funding is available in Account No. 001-13-035-5470-00-10-000.
STAFF LEVEL IMPACT: Acceptance of this recommendation will have no effect on current staffing
level.
SUMMARY: Staff recommends that the City Council adopt P. R. No. 22596, ratifying an emergency
contract to Lark Group Inc., in the amount of$31,742.00.

A RESOLUTION RATIFYING THE CITY MANAGER'S DECISION
TO EXECUTE AN EMERGENCY CONTRACT WITH LARK GROUP
INC., IN THE AMOUNT OF $31,742.00 FOR ASBESTOS/LEAD
ABATEMENT AND DEMOLITION OF A DANGEROUS CITY-
OWNED COMMERCIAL PROPERTY LOCATED 723 FREEMAN
AVENUE AKA TEXAS AVENUE/501 W. 7TH STREET, TO BE
CHARGED TO ACCOUNT NO.001-13-035-5470-00-10-000(GENERAL
FUND-OTHER CONTRACTUAL SERVICES)
WHEREAS, a City-owned commercial structure located at 723 Freeman Avenue aka Texas
Avenue/501 W. 7th Street was in imminent danger of collapse;and as a result,it was necessary to perform an
emergency demolition of the building per Section 108,Unsafe Structures,of the 2012 International Property
Maintenance Code; and
WHEREAS, this situation constitutes an emergency procurement under Texas Local Government
Code 252.022, Section(2), "a procurement necessary to preserve or protect the public health or safety of the
municipality's residents"; and,
WHEREAS, the City's Asbestos Consultant solicited quotes for emergency demolition and Lark
Group submitted the lowest and most responsive bid.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT,the facts and opinions in the preamble are true and correct; and
THAT the City Council of the City of Port Arthur hereby ratifies the contract for asbestos/lead
abatement and demolition of 723 Freeman Avenue aka Texas Avenue/501 W. 7th Street in the City of Port
Arthur,to the best and lowest responsible bidder to-wit:Lark Group Inc.,as delineated in Exhibit"A";and,
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
READ, ADOPTED, AND APPROVED this the 7th day of June,A.D.,2022, at a Regular Meeting of the
City Council of the City of Port Arthur, Texas by the following vote:

CITY OF PORT ARTHUR, TEXAS
STANDARD FORM OF AGREEMENT
THIS AGREEMENT made this JO Nay of in the year 2022, by and between the City of
Port Arthur, a legal entity organized and existing in the State of Texas, hereinafter designated as the
Owner, and Lark Group Inc., hereinafter designated as the Contractor. The Owner and the Contractor, in
consideration of the mutual covenants hereinafter set forth, agree as follows:
ARTICLE 1. THE WORK
The Contractor shall complete the Work as specified or indicated under the demolition and asbestos/lead
specifications of the Owner's Contract Documents entitled:
ASBESTOS/LEAD ABATEMENT/DEMOLITION OF 723 FREEMAN AVENUE AKA TEXAS
AVENUE/501 W. 7TH STREET
The Work is generally described as follows: Asbestos/Lead Abatement and Demolition
ARTICLE 2. TIME OF COMMENCEMENT OF COMPLETION
The Work to be performed under this Contract shall be commenced on the date specified by the Owner in
the Notice to Proceed and the Work shall be fully completed within five (5) working days after the date
of commencement of the Work.
The Owner and the Contractor recognize that time is of the essence of this Agreement and that the Owner
will suffer financial loss if the Work is not completed within the time specified in this Article 2, herein,
plus any extensions thereof allowed by the City. They also recognize the delays, expense, and difficulties
involved in proving in a legal proceeding the actual loss suffered by the Owner if the Work is not
completed on time. Accordingly, instead of requiring any such proof, the Owner and the Contractor agree
that as liquidated damages for delay (but not as a penalty) the Contractor shall pay the Owner the sum of
$150.00 for each calendar day that expires after the time specified in this Article 2,herein.
ARTICLE 3. CONTRACT PRICE
The Owner shall pay the Contractor for the completion of the Work in accordance with the Contract
Documents in current funds the Contract Price(s), Thirty-One thousand, seven hundred forty-two
dollars and no cents($31,742.00).
ARTICLE 4. THE CONTRACT DOCUMENTS
The Contract Documents also consist of: this Agreement, Asbestos or Technical Specifications,
Demolition, and all Change Orders and Work Directive Changes which may be issued subsequent to the
Effective Date of the Agreement and are not attached hereto.
ARTICLE 5. PAYMENT PROCEDURES
Payment will be made in full when all of the work is completed and approved by City staff with provision
for damages in accordance with Article 2 of this Agreement.
ARTICLE 6. NOTICES
Whenever any provision of the Contract Documents requires the giving of written Notice, it shall be
deemed to have been validly given if delivered in person to the individual or to a member of the firm or to

an officer of the corporation for whom it is intended,or if delivered or sent by registered or certified mail,
postage prepaid, to the last business address known to the giver of the Notice.
ARTICLE 7. MISCELLANEOUS
The contractor shall comply with State law as to licensing on asbestos abatement and disposal.
No assignment by a party hereto of any rights under or interests in the Contract Documents will be
binding on another party hereto without the written consent of the party sought to be bound; and
specifically, but without limitation, monies that may become due and monies that are due may not be
assigned without such consent (except to the extent that the effect of this restriction may be limited by
law), and unless specifically stated td the contrary in any written consent to an assignment, no assignment
will release or discharge the assignor from any duty or responsibility under the Contract Documents.
The Owner and the Contractor each binds itself, its partners, successors, assigns, and legal representatives
to the other party hereto, its partners, successors, assigns, and legal representatives in respect to all
covenants,agreements, and obligations contained in the Contract Documents.
IN WITNESS WHEREOF, the Owner and the Contractor have caused this Agreement to be executed the
day and year first written above.
