Background: Due to damages from Hurricane Harvey, the Texas Commission on Environmental Quality (TCEQ) required the City of Port Arthur to remediate the oil spill and abatement of asbestos caused by Engine 503 and Hurricane Harvey. The City of Port Arthur has complied with the requirements of TCEQ and once the fees are paid, TCEQ will unconditionally approve that no further action for that site is needed. Budget Impact: Funds are available Account Number 001-25-065-5420-00-20-000 Recommendation: It is recommended that the City Council approve P. A RESOLUTION AUTHORIZING THE PAYMENT OF FEES OWED TO THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY (TCEQ) IN REFERENCE TO THE REMEDIATION OF THE OIL SPILL FROM ENGINE 503 AND TENDER (TRAIN) AT BRYAN PARK IN THE AMOUNT OF $31,739.78; FUNDING AVAILABLE IN ACCOUNT NUMBER 001-25-065- 5420-00-20-000 WHEREAS, due to damages from Hurricane Harvey, the Texas Commission Environmental Quality (TCEQ) required the City to remediate the oil spill under Engine 503 and Tender(train) in Bryan Park and abatement of the asbestos at that site; and, WHEREAS, TCEQ has sent a Conditional Approval of No Further Action Report as attached hereto as Exhibit "A"; and, WHEREAS, the City of Port Arthur has to pay fees owed in the amount of$31,739.78; and, WHEREAS, once the City of Port Arthur pays the fees, TCEQ will unconditionally approve with no further action at the site of Engine 503 and Tender (train) at Bryan Park; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR TEXAS: Section 1. THAT the facts and opinions in the preamble are true and correct. Section 2. THAT the City of Port Arthur is hereby authorized to pay fees in the amount of$31,739.78 for TCEQ to unconditionally approve with no further action at the site of Engine 503 and Tender (train) at Bryan Park. Section 3. THAT a copy of the caption of this resolution be spread upon the minutes of the City Council. Please see the request for information below.The comments do not require a response. Comments 1. In its August 19, 2019 letter,the TCEQ addressed the site assessment and remedial activities that occurred prior to the November 19, 2019 sampling event described below. In the letter,the TCEQ requested additional soil assessment of arsenic and lead. 2. On November 20, 2019, 12 borings were completed and 12 soil samples were collected for analysis of both arsenic and lead in the vicinity of Tio and TJJ locations. Based on those results, additional assessment of arsenic in soil was necessary. 3. On January 23, 2020, 12 borings were completed and 24 soil samples were collected for analysis of arsenic. Reported arsenic concentrations for all samples were below the critical protective concentration level(PCL-TotSoilcomb).The results show that the arsenic exceedances are localized in a small area near locations no and Tn. 4. On April 20, 2020,soil was excavated in the area encompassing locations Tito and Tn. Confirmation samples show that the arsenic PCL exceedance zone was removed. The executed manifest provided shows that approximately 9.64 tons of soil was disposed off-site. 5. The City of Port Arthur has past due fees in the amount of$31,739.78. Once the City of Port Arthur pays the past due fees,the TCEQ will unconditionally approve no further action for the site.
