AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE RUNOFF ELECTION, HELD ON JUNE 11, 2022 FOR THE PURPOSE OF ELECTING A MAYOR IN THE CITY OF PORT ARTHUR, TEXAS WHEREAS,the City of Port Arthur is a home rule city with a governing body composed of a Mayor and six (6) Councilmembers. The term for the Mayor is three years; and WHEREAS, pursuant to Ordinance No. 22-06, the General Election was held on May 7, 2022, for the purpose of electing a Mayor; and WHEREAS, on May 18, 2022 the results of the General Election were canvassed, and the City Council adopted Ordinance No. 22-37 declaring that there were more than two (2) candidates for the office of Mayor and no candidate received a majority of all votes cast for the office; and WHEREAS, Thurman Bill Bartle and Floyd Batiste were the two (2) candidates who received the highest number of votes for Mayor in the General Election; and WHEREAS, pursuant to Ordinance No. 22-37 on May 18, 2022, a Runoff Election was held on June 11, 2022 for the purpose of electing a Mayor; and WHEREAS, the date to canvass the election is June 22, 2022. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the returns of said Runoff Election, after being canvassed by the City Council are found and declared to be true and correct. There were cast at said election for the respective candidates the number of votes shown on the tabulated statements that are attached hereto and made a part hereof as Exhibit "A" and as delineated below: S. 1011 1 Mayor: Thurman Bill Bartle Floyd Batiste Section 3. That based on the representations of the County Clerk, that she conducted the Election in accordance with state, local and federal law, and based on the presumption under the law that the election judges are presumed to have done their duty, the City Council has determined that the Runoff Election was duly called, ordered, and held in accordance with the laws of the State of Texas, the Charter of the City of Port Arthur, Ordinance No. 22-37, that the Order for the conduct of the Runoff Election and the returns thereof, have been made by the proper officials, and the results of the June 11, 2022 Runoff Election have been submitted. Section 5. Therefore, Thurman Bill Bartie is hereby declared to be elected as Mayor. That term for Mayor shall commence on the date that Thurman Bill Bartle is duly qualified and shall expire in May 2025, or until his successor has been elected and duly qualified. Section 6. That the City Council shall therefore be composed of the following members: District/Position Term Expiration of Term Thurman Bill Bartle Mayor 3 years May 2025 Ingrid Holmes District 1 3 years May 2023 Cal Jones District 2 3 years May 2023 Thomas Kinlaw, III.
