The Port Arthur Zoning Board of Adjustment & Appeals will meet in regular session
at 5:30 p.m., Thursday, July 30, 2009, in the City Council Chambers on the fifth floor
of the City Hall. The July 30th agenda contains one application.
Please make every effort to attend so that we may have a quorum. If for some reason

Public Hearing - 5:40 P.M.
CITY HALL - 5TH FLOOR CONFERENCE ROOM
Roll Call -John Clayton, Hoa "Homie" Dinh, Eddie Scaggs and Lillie Williams [alternate) were
present to constitute the necessary quorum. Staff Members present: Planning Director, Colleen
Russell
II. Minutes -May 14, 2009 -Public Hearing
Hoa "Homie" Dinh moved to accept the minutes of May 14, 2009 as presented.
Vote -All Yeas -- motion passed.
III. B09-07 and B09-08 (Public Hearing on each followed by Motion required on each)
A. B09-07 -Bessie Lawrence -Lot 7, Block 15, Port Arthur Land Company, A-53460 (447 W.
17tH Street) Variance for 10-foot deficit in lot width - i.e. lot is currently 50 feet wide
instead of the required 60-foot lot width.
Speaking for: Nick Leiseth - 4507 Cannongate Drive, Spring, TX 77373
Speaking against: None
Mr. Leiseth stated that a variance is needed for said property to request an additional five
foot side set-back for new construction.
Mr. Clayton asked if said property was a hardship. Mr. Leiseth responded that the house is
being built due to a Government grant program. Ms. Russell also explained that property
owners under this program cannot afford to purchase additional land to meet required set-
backs; therefore a variance is needed to ensure construction.
Motion to approve was made by Eddie Scaggs; seconded by Lillie Williams: Item approved
unanimously.
B. B09-08 -Sarah January -Lot 6, Block 218, Port Arthur Land Company, A-053400 (2802 Stn
Street) -Variance for 10-foot deficit in lot width - i.e. lot is currently 50 feet wide
instead of the required 60-foot lot width.

Mr. Scaggs asked if new construction will be multi-family or duplex housing. Mr. Leiseth
explained that the current home will be demolished and a new single-family residence will
be constructed.
Motion to approve was made by Eddie Scaggs; seconded by Lillie Williams: Item
approved unanimously.
IV. Report from Director - Ms. Russell informed Commissioners of additional alternates being
appointed to the ZBA.
V. Future Agenda Items -Planning Department expects to receive 30 or 40 additional applications
requiring variances.

BACKGROUND:
The Board of Adjustment is being asked to consider a variance for the following
lot(s)/tract(s) in the City of Port Arthur, Jefferson County, Texas.
VARIANCES WILL BE ON THE FOLLOWING LOT:

501 SABINE AVENUE 50 x 135 60 x 135 10~ SIDE (FIFTH STREET
This site is located north of Proctor Street and east of Sabine Avenue. It is also
known as Lot 24, Block 5, Terrace Addition, P.A.L.C.O. (Port Arthur Land Company),
Port Arthur, TX 77642-1440. The zoning is "2F" Two-Family housing or Duplex.
Notices were sent out in compliance with the Texas Local Government Code Section
211 as well as the publication being done on July 12TH, for the July 30t" meeting
more than 15 days prior to the public hearing

RECOMMENDATION:
Staff has no objections to this request due to the hardship of the family not being
able to afford more land, yet desiring to have the same number of bedrooms as
before and in line according to City Codes.

SUMMARY:
The Zoning Board of Adjustment is requested to reduce the 5 foot set backs on the
Fifth Street side. The City requests no fencing, shrubbery or trees to cause visibility
problems. Hedge shall be 2 feet or less. Other lots with similar situations will not
meet the Code with insufficient side setbacks and will not conform to the
Subdivision/ Zoning Ordinances. Nevertheless, a legal request is being made prior to
the redevelopment of the lot allowing for the householder to be "legally-
conforming."
