Introduction:
The intent of this Agenda Item is to request the City Council's approval of P. R. No. 22643
approving a volunteer agreement with the Community In-Power and Development Association
as it pertains to its Green Infrastructure Pilot Program in Montrose Park.
Background:
The Community In-Power and Development Association (CIDA) has partnered with
Anthropocene Alliance to form partnerships to bring in technical assistance and resources to
reduce the impacts of flooding in vulnerable neighborhoods like Montrose. CIDA is requesting
approval for the Green Infrastructure Pilot Program to install a raingarden and permeable
pavement in Montrose Park. This pilot program requires no funding from the City of Port
Arthur.
Budget Impact:
None
Recommendation:
It is recommended that the City Council approve P. R. No. 22643 approving the Community
In-Power and Development Association's Green Infrastructure Pilot Program in Montrose
Park.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE EXECUTION OF A
VOLUNTEER AGREEMENT BETWEEN THE CITY OF PORT ARTHUR
AND THE COMMUNITY IN-POWER AND DEVELOPMENT
ASSOCIATION (CIDA) AS IT PERTAINS TO THE GREEN
INFRASTRUCTURE PILOT PROGRAM TO BE IMPLEMENTED AT
MONTROSE PARK.
WHEREAS, the health, safety and well-being of the City of Port Arthur residents is an
ongoing concern given the city's vulnerable position to the impacts of climate change including
hurricanes, extreme temperatures, and extreme precipitation; and,
WHEREAS, the Community In-Power and Development Association (CIDA) has
partnered with Anthropocene Alliance to form partnerships to bring in technical assistance and
resources to reduce the impacts of flooding in vulnerable neighborhoods like Montrose; and,
WHEREAS, CIDA desires to initiate the Green Infrastructure Pilot Program. Through
this program, the organization wishers to install a raingarden and permeable pavement in
Montrose Park for the benefit of the citizens of Port Arthur as attached hereto as Exhibit"A; and,
WHEREAS, this project requires no funding from the City of Port Arthur; now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Council deems it is in the best interest of the City of Port
Arthur to authorize the execution of an agreement between the City of Port Arthur and CIDA as it
pertains to the Green Infrastructure Pilot Program to be implemented at Montrose Park, as
delineated in Exhibit B.
Section 3. That a copy of the caption of this Resolution be spread upon the Minutes
of the City Council.

Community Driven Green Infrastructure Pilot Project

Background UA
• Post- Harvey issues with flooding in Montrose became clear. Even low level rain
events will cause flooding and standing water in Montrose.
• Residents reached out to CIDA for help.
• CIDA partnered with Anthropocene Alliance to form partnerships to bring in
technical assistance and resources to reduce the impacts of flooding in vulnerable
neighborhoods like Montrose.
• The long term goal is to create a pilot location with demonstrated benefits and
replicable strategies to benefit other flood-prone neighborhoods in Port Arthur,
and to get the funding necessary to implement those expansions.
Partners
• Anthropocene Alliance is,through a National Fish and Wildlife Fund grant,funding the implementation of
the GI pilot Raingarden.
• Texas A&M University, is developing a Green Infrastructure (GI) Master Plan which will include data for all of
Port Arthur, but expand on detailed GI recommendations for Montrose.
• The Texas A&M team led by:Professors from the Landscape Architecture and Urban Planning Department:
• Dr.Galen Newman,Director of the Center for Housing and Urban Development
• Dr.John T.Cooper,Director of the Texas Target Communities Program
• River Network assisted us in conducting in-depth interviews and integrating community input into the Texas
A&M GI Master Plan.
• Lamar University Beaumont has partnered with CIDA to add a permeable pavement test site to the GI pilot
Raingarden in Montrose.They are currently finalizing technical design plans for review by GIFT.
• The permeable pavement project is led by:
• Dr.Qin Qian,Professor,Civil&Environmental Engineering
• Dr.Liv Haselbach,Director of the Center for Resilience
• Texas A&M University Agrilife Extension Green Infrastructure For Texas(GIFT) is our implementation partner
and will assist in reviewing the technical designs for the project.

• Formal permission to install both the permeable pavement and the
raingarden in Montrose Park.
• The project requires no funding from the City of Port Arthur.
• In-kind contributions are welcome, applauded and appreciated, but not
needed for the success of the project. We have already secured technical
assistance and funding.

EXHIBIT B
VOLUNTEER ORGANIZATION
INDEMNIFICATION AND HOLD HARMLESS AGREEMENT
THIS AGREEMENT, made this day of , 2022,
by and between the City of Port Arthur, a municipal corporation
organized under the laws of the State of Texas, hereinafter " CITY" and
Community In-Power and Development Association (CIDA), a 501(c)(3)
non-profit herein acting by and through its
, agrees as follows:
1. The term of this agreement shall be from , 2022 to
, 2022.
2. CIDA agrees to install a raingarden and permeable pavement in
Montrose Park as depicted in Exhibit "A". By my signature on this
document, the volunteer organization (CIDA) assumes all liability
from any cause whatsoever that may arise out of or in connection
with its activities as a community volunteer.
3. CIDA AGREES TO INDEMNIFY AND HOLD HARMLESS the City of
Port Arthur, its elected and appointed officials, employees, workers
and agents and others working on behalf of the City of Port Arthur
against any and all claims, expenses, damages, demands, liabilities,
suits, actions, or judgments, including all costs connected therewith,
and for any damages which may be asserted, claimed or recovered
against or from the City of Port Arthur, its elected and appointed
officials, employees, agents, or workers, by reason of personal injury,
including bodily injury or death and/or property damage, including
loss of use thereof, which arises out of or is in any way connected or
associated with the volunteer work and improvements made at
Montrose Park and understand that CIDA assumes whatever risk
may entail or accrue to the organization.
4. THIS INDEMNITY AND HOLD HARMLESS AGREEMENT INCLUDES
ANY ACT OR OMISSION OF THE CITY OF PORT ARTHUR OF ANY
NATURE, INCLUDING NEGLIGENCE AND GROSS NEGLIGENCE BY
THE CITY, ITS AGENTS, EMPLOYEES WORKERS, OFFICERS AND
LEGAL REPRESENTATIVES WHETHER CAUSED BY
CONTRIBUTORY AND/OR SOLE NEGLIGENCE AND/OR GROSS
NEGLIGENCE.

5. CIDA AGREES TO RELEASE THE CITY, ITS AGENTS,
EMPLOYEES, WORKERS, OFFICERS, AND LEGAL
REPRESENTATIVES FROM ALL LIABILITY FOR INJURY, DEATH,
DAMAGE, OR LOSS TO PERSONS OR PROPERTY SUSTAINED IN
CONNECTION WITH OR INCIDENTAL TO PERFORMANCE UNDER
THIS AGREEMENT, EVEN IF THE INJURY, DEATH, DAMAGE, OR
LOSS IS CAUSED BY THE CITY'S SOLE OR CONCURRENT
NEGLIGENCE AND/OR THE CITY'S STRICT PRODUCTS
LIABILITY OR STRICT STATUTORY LIABILITY.
6. VOLUNTEER ORGANIZATION agrees to install a raingarden and
permeable pavement in Montrose Park.
7. VOLUNTEER ORGANIZATION agrees that all work plans must be pre-
approved by the City Engineer prior to proceeding with any work.
8. VOLUNTEER ORGANIZATION will be responsible for all costs
associated with said project and maintain the improvements to the
property.
9. This is the entire Agreement of the parties and it shall be binding
upon all parties hereto and their respective heirs, executors,
administrators, successors and assigns.
10. IN WITNESS WHEREOF, the parties hereto have executed, or
caused to be executed by their duly authorized officials, this
Agreement in (2 copies) each of which shall be deemed an original on
the date first above written.
