HomeMy WebLinkAboutPR 22715: AUTHORIZING AMENDMENT NO. 7 TO THE SOFTWARE AS A SERVICE AGREEMENT (SAAS) WITH TYLER TECHNOLOGIES Cite of urt rth'ur Ti.ru, www.PortArthurTx.gov INTEROFFICE MEMORANDUM Date: July 22, 2022 To: The Honorable Mayor and City Council Through: Ronald Burton, City Manager From: Fay Young, Information Technology Director RE: Proposed Resolution No. 22715 —Tyler schedule, applications, and schedule change Introduction: The intent of this Agenda Item is to seek the City Council's authorization for the City Manager to approve Ammendment#7 to the Software as a Service Agreement(SAAS)with Tyler Technologies to remove Executime mobile modules and to change the implementation dates for EnerGov. Background: On September 10, 2019, City Council approved Resolution 19-392, an agreement with Tyler Technologies to implement an Enterprise Resource Planning(ERP) system. The agreement included mobile versions of the Executime Time and Attendance system. The City will not be utilizing the mobile versions of the application. Therefore,the application and cost associated with it will be removed. The agreement also had the implementation of Energov scheduled to begin April 2022. Since the Energov implementation will not begin until August of 2022,the quarterly payment schedule needs to be adjusted. The City is due a credit of$63,987.50 for EnerGov charges included in the the April 1, 2022 and August 1, 2022 billing quarters. Budget Impact: The annual SaaS fees payment obligation commencing October 1, 2022 will be reduced by $5,482 due to the removal of the ExecuTime Advanced Scheduling Mobile Access ($2,408) and the ExecuTime Time &Attendance Mobile Access($3,074). The City will be issued a credit in the amount of$63,987.50 due to the delayed EnerGov implementation schedule. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 7 TO THE SOFTWARE AS A SERVICE AGREEMENT (SAAS) WITH TYLER TECHNOLOGIES APPROVED PURSUANT TO RESOLUTION 19-392 TO REMOVE EXECUTIME MOBILE APPS AND TO ADJUST THE QUARTLY SAAS PAYMENT SCHEDULE FOR THE DELAY IN THE IMPLEMENTATION OF THE ENRGOV SYSTEM. WHEREAS,the City of Port Arthur entered into an agreement with Tyler Technologies to implement an Enterprise Resource Planning System, approved by Council Resolution 19-392; and WHEREAS, the mobile applications for Executime will not be used and need to be removed from the agreement; and WHEREAS,the agreed start date for the EnerGov implementation was delayed from April 2022 until August 2022; and WHEREAS, the quarterly SaaS payments for the quarters beginning April 2022 and July 2022 included the costs for EnerGov; and WHEREAS,the City desires to discontinue paying the yearly access fees of$5,482.00 for the Executime Mobile applications; and WHEREAS, the City desires to be credited for the EnerGov quarterly SaaS payments in the amount of$63,987.50 for the quarters beginning April 2022 and August 2022; and WHEREAS,the amendment to the agreement is attached hereto as"Exhibit A". NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Council hereby authorizes the City Manager to execute Amendment No. 7 to the Tyler Technologies agreement to remove the Executime mobile P.R. NO. 22715 FY 7/22/2022 applications, adjust the payment schedule, and receive credit due to the delay of the EnerGov implementation. Section3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. This Amendment, upon execution,shall serve as Client's documentation for the credit issued (the executed Amendment is your credit invoice from Tyler). 5. This Amendment shall be governed by and construed in accordance with the terms and conditions of the Agreement. 6. Except as expressly indicated in this Amendment,all other terms and conditions of the Agreement shall remain in full force and effect.
