Introduction: The intent of this Agenda Item is to request the City Council's approval o f P.R. No. 22472 authorizing the City Manager to purchase 100 tilting trash receptacles from Pilot Rock of RJ Thomas Mfg. Co. Inc. in the not-to-exceed amount of$48,800.00. RJ Thomas Mfg. Co. Inc. is the sole manufacturer of this particular trash receptacle. This procurement is exempt from the bid process under Texas Local Government Code Section 252.022, General Exemptions (a) (7) (A), items that are available from only one source because of patents,copyrights, secret processes, or natural monopolies. Background: The Pleasure Island Department currently has aged trash receptacles throughout the island. The purchase of tilting trash receptacles is needed to replace trash collection containers for continued use by citizens and tourists. The Pleasure Island Department would like to purchase tilting trash receptacles in an effort to keep Pleasure Island clean. Budget Impact: There will be a budgetary impact of$48,800.00 for this purchase in account No. 140-15-600- 5470-00-00-000, Project No. H07915-OTH-OCS. WHEREAS, the Pleasure Island Department currently has aged trash receptacles throughout the island that needs replacement for the continued use by the visitors; and WHEREAS,the Pleasure Island Department has requested to purchase tilting trash receptacles in an effort to keep the Island clean and litter free; and WHEREAS, a quote was received from Pilot Rock of RJ Thomas Mfg. Co. of Cherokee County, Iowa for the purchase 100 Pilot Rock Model CN-TR/CB-52RB Tilting Trash Receptacles in the total amount not to exceed $48,000.00; and WHEREAS, RJ Thomas Mfg. Co. submitted a letter correspondence stating that the company is the sole manufacture of this particular product as delineated in Exhibit"A"; and WHEREAS, this procurement is exempt from the bid process under Texas Local Government Code Section 252.022, General Exemptions (a) (7) (A), items that are available from only one source because of patents, copyrights, secret processes, or natural monopolies; now,therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. No. 22296—APPROVING THE EMERGENCY ASBESTOS ABATEMENMT AND DEMOLITION OF A DANGEROUS COMMERCIAL STRUCTURE AT THE PROPERTY DESCRIBED AS 3100 GULFWAY DRIVE (COLLAPSED COMMERCIAL BUILDING) COMMENT RECOMMENDATION: Staff recommends that the City Council adopt P. R. No. 22296 authorizing the City Manager to pay Lark Group, Inc. in the amount of $107.800.00 for the emergency asbestos abatement and demolition of the commercial property located at 3100 Gt:lfway Drive. BACKGROUND: The commercial structure located at 3100 Gulfway Drive partiallycollapsec on 08/10/22 and was in imminent danger of collapsing further. As a result, it became necessary to immediately perform emergency demolition of the structure per Section 108, Unsafe Structt-rei, of the 2015 International Property Maintenance Code. Lark Group, Inc.was the lowest responsible bidder, and was contracted to perform the emergency demolition of the structure. Please find attached my memo to the City Manager which gives a summary of the events. We secured four (4) emergency quotes for this work. Lark Group, Inc. is the lowest most responsive bidder; their bid was 8107,800.00. Lark Group, Inc. bid $107,800.00, Sitek Cmn Services, I.I.C. bid$1 14,800.00,Inland Environments Ltd.bid$148,800.00 and AAR Incorporated bid$145,800.00.Bid award is based on the lowest and most responsive bid. BUDGET AND REVENUE IMPACT: Acceptance of this recommendation will not require a budget amendment. Funding is available in Account No. 001-13-035-5470-00-10-000; Genera.
