In April of 2021, the Council passed Resolution No. 21-133, awarding the Rehabilitation of the Pioneer Park Lift Station contract to BDS Constructors, LLC dba MK Constructors of Vidor, Texas. The project engineer is Arceneaux, Wilson, &Cole, LLC of Port Arthur, Texas as delineated in Resolution No. 19-264. In August of 2021,the Council passed Resolution No. 21-340, awarding Change Order No. 1 as a non-monetary change order extending the contract time by sixty (60) days due to shipping delays by the equipment supplier for the project's submersible pumps. Change Order No. 2 is also a non-monetary change order extending the contract time by one hundred eighty-eight(188) days due to delays by Entergy and various equipment shipment delays. Background: In April of 2021, the Council passed Resolution No. 21-133, awarding the Rehabilitation of the Pioneer Park Lift Station contract to BDS Constructors, LLC dba MK Constructors of Vidor, Texas.Per Rresolution, 19-264,the project engineer is Arceneaux, Wilson,&Cole,LLC of Port Arthur, Texas. Budget Impact: No impact. Recommendation: It is recommended that City Council adopt Proposed Resolution No. 22731, which authorizes the acceptance of Change Order No. 2 for the Rehabilitation Project at the Pioneer Park Lift Station. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 2 BETWEEN THE CITY OF PORT ARTHUR AND BDS CONSTUCTORS, LLC DBA MK CONSTRUCTORS OF VIDOR, TEXAS, EXTENDING THE CONTRACT TIME BY ONE HUNDRED EIGHTY-EIGHT (188) DAYS FOR THE PIONEER PARK LIFT STATION REHABILITATION PROJECT. WHEREAS, per Resolution No. 19-264, the City Council approved a contract with Arceneaux, Wilson& Cole, LLC to provide engineering design and construction services for the rehabilitation of Pioneer Park Lift Station in the not to exceed amount of$126,200.00; and, WHEREAS, per Resolution No. 21-133, City Council approved the Rehabilitation Project at the Pioneer Park Lift Station in the amount of $774,065.00, made with BDS Constructors, LLC dba MK Constructors of Vidor,Texas; and, WHEREAS, per Resolution No. 21-340, City Council approved Change Order #1, extending the contract time by 60 days due to shipping delays by the equipment supplier; and, WHEREAS, the project engineering firm, Arceneaux Wilson & Cole LLC, has submitted Change Order #2 (attached hereto as Exhibit "A") for the Rehabilitation Project at the Pioneer Park Lift Station, extending the contract time by one hundred eighty-eight (188) days due to Entergy's delays and various equipment shipment delays. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT,the facts and opinions in the preamble are true and correct; and, THAT,the City Manager of the City of Port Arthur is hereby authorized and directed to execute Change Order No. 2 with BDS Constructors, LLC dba MK Constructors of Vidor, Texas, for the Rehabilitation Project at the Pioneer Park Lift Station, extending the contract time by one hundred eighty-eight (188) days due to Entergy's delays and various equipment PR No. 22731 8/18/2022 ta/bw Page 2 of 2 shipment delays; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. This change order is for extending the contract time by one hundred eighty-eight (188) calendar days. The Contractor has experienced delays regarding Entergy's involvement with the project. Over the past two months, Entergy has experienced supply chain delays with their necessary appurtenances for influent main power connection at the lift station site. The Contractor has now received all the necessary equipment from Entergy and can move forward with its installation. Also, the equipment supplier for the project's level transmitters has informed the Contractor of an 8-week shipping delay beyond the original anticipated delivery timeframe. The Contractor has currently completed all the project's scope of work,with exception to final electrical connection, pump start-up, and existing force main tie-in. This change order will add 188 Calendar Days to the original contract time to account for the experienced equipment and Entergy delays, and reconcile the previously requested 113 day extension via the original Change Order No. 2. There are no costs associated with this change order. We recommend that the City of Port Arthur authorize this change order to the contract as submitted. We have attached Change Order No. 2 which modifies the contract to reflect this change for your consideration and action.
