RE: A Resolution Approving a Property Damage Settlement in the Amount of$8,690.09 for
Damages to Fire Engine Unit#2184
Nature of the request: On June 28, 2022, the operator of Fire Unit #2184 (2017 Pierce
Fire Engine) was pulling out of Station #3 and swiped the side of the unit damaging the back
door handle.
Staff Analysis, Considerations: The City has Automobile Physical Damage insurance
coverage through Texas Municipal League Intergovernmental Risk Pool (TMLIRP) with a
$2,500 deductible. TMLIRP has offered the City a settlement of $8,690.09, less the $2,500
deductible, making the final settlement offer$6,190.09.
Recommendation: I recommend approval of Proposed Resolution No. 22585 authorizing the
property damage settlement against TMLIRP for damage sustained to Unit #2184 (2017 Pierce
Fire Engine). TMLIRP has offered to settle the claim for $8,690.09, less the $2,500 deductible,
making the final settlement offer $6,190.09. This is considered a fair and reasonable settlement.
Budget Considerations: The funds received will be deposited in the Insurance Proceeds
Account: 001-00-00-4744-00-000-00, HINGF.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER
TO EXECUTE SETTLEMENT OF A PROPERTY DAMAGE CLAIM
IN THE AMOUNT OF $8,690.09 MADE AGAINST
TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TMLIRP)
AS A RESULT OF PROPERTY DAMAGE TO A 2017 PIERCE FIRE ENGINE, UNIT #2184
4 WHEREAS, on June 28, 2022, the operator of Fire Engine Unit #2184 (2017 Pierce Fire
Engine) was pulling out of Fire Station #3 and swiped the side of the unit damaging the backdoor
handle; and,
WHEREAS, as a result of the damage, a claim was filed with the Texas Municipal League
Intergovernmental Risk Pool (TMLIRP); and,
WHEREAS, TMLIRP has offered to settle the claim for $8,690.09 less the Automobile
Physical Damage deductible amount of $2,500, making the final settlement $6,190.09, which is
considered a fair and reasonable settlement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
Section 1 . That, the facts and opinion in the preamble of this Resolution are true and
correct.
Section 2. That, the City Manager is hereby authorized to execute settlement in the
amount of $8,690.09, less the Automobile Physical Damage deductible
amount of $2,500, making the final settlement $6,190.09 for the claim
against TMLIRP (see Exhibit "A").
Section 3. That a copy of this Resolution be spread upon the minutes of the City
Council.
