HomeMy WebLinkAbout(1) 09/01/2022 SPECIAL MEETING SPECIAL MEETING — September 1, 2022 I. INVOCATION, PLEDGE & ROLL CALL Councilmember Moses gave the invocation followed with the pledge to the flag. The City Council of the City of Port Arthur met in Special Session on Thursday, September 1, 2022 at 10:14 a.m. in the City Council Chamber, City Hall, with the following members present: Mayor Pro Tern Ingrid Holmes; Councilmembers Thomas Kinlaw, III, Kenneth Marks, Charlotte Moses and Donald Frank, Sr.; City Manager Ron Burton; City Secretary Kelly Moore; City Attorney Valecia R. Tizeno and Sergeant At Arms Police Chief Tim Duriso. Mayor Thurman Bill Bartie was absent from the Special Meeting. Mayor Pro Tern Holmes chaired the meeting. Councilmember Cal Jones joined the meeting at 10:20 a.m. II. PUBLIC HEARINGS — 10:00 A.M. To Receive And Consider And Consider Public Comment(s) For All Interested Citizens With Regard To The City Of Port Arthur's Proposed Tax Rate For The 2022 Tax Year A Tax Rate Of 0.0691535 Per $100 Valuation Has Been Proposed By The Governing Body Of City Of Port Arthur PROPOSED TAX RATE $0.691535 per $100 NO-NEW REVENUE TAX RATE $0.617512 per $100 VOTER-APPROVAL TAX RATE $0.691535 per $100 The No-New-Revenue Tax Rate Is The Tax Rate For The 2022 Tax Year That Will Raise The Same Amount Of Property Tax Revenue For City Of Port Arthur From The Same Properties In Both The 2021 Tax Year And The 2022 Tax Year 0 The Voter-Approval Rate Is The Highest Tax Rate That City Of Port Arthur May Adopt Without Holding An Election To Seek Voter Approval Of The Tax Rate The Proposed Tax Rate Is Greater Than The No-New-Revenue Tax Rate. This Means That City Of Port Arthur Is Proposing To Increase Property Taxes For The 2022 Tax Year The Public Will Also Be Able To View The Public Hearing Via The City's Website At www.portarthurtx.gov The Mayor Pro Tem introduced the above-mentioned Public Hearing at 10:18 a.m. Finance Director Kandy Daniel appeared before the City Council and gave an overview of the above-mentioned item. The Mayor Pro Tem requested to hear from anyone present in the audience who wished to speak regarding the above-mentioned item. No one appeared before the City Council to address the above-mentioned item. Upon the motion of Councilmember Moses, seconded by Councilmember Frank and carried unanimously, the City Council closed the Public Hearing at 10:25 a.m. III. ITEMS REQUIRING INDIVIDUAL ACTION NON-CONSENT (1) P.O. No. 7092 — An Appropriation Ordinance Adopting A Budget For The Ensuing Fiscal Year Beginning October 1, 2022 And Ending September 30, 2023, In Accordance With Section 7, Article XII Of The Charter Of The City Of Port Arthur. A Separate Ratification Vote Is Required Pursuant To Section 102.007(c) Of The Texas Local Government Code Two (2) Record Votes Required The Mayor Pro Tern introduced the above-mentioned Proposed Ordinance. The motion was made by Councilmember Moses and seconded by Councilmember Kinlaw that Proposed Ordinance No. 7092 be adopted. Finance Director Kandy Daniel appeared before the City Council to answer inquiries regarding the above-mentioned topic and outlined the proposed amendment. The motion was made by Councilmember Kinlaw and seconded by Councilmember Frank that Proposed Ordinance No. 7092 be amended by changing the cost of living raise from 3.5% to 4.0% with changes the following set forth by the Finance Director Kandy Daniel: General Fund Remove legal services in Special Purpose Reduction ($70,000.00) Fund Emergency Preparedness Position Reduction ($98,000.00) Reduce transfer for Cap Res — Generator to be grant Reduction ($100,000.00) funded ($268,000.00) Water Fund Reduce transfer for Cap Res-Vactor Truck Reduction ($480,000.00) Reduce transfer for CIP — Lift Stations Reduction ($1,000,000.00) ($1,480,000.00) Total Operating Funds Reduction 1 748 000.00 P 9 ($ � � ) Capital Reserve Fund Remove Generator at H.O. IThe caption of Ordinance No. 22-62 reads as follows: ORDINANCE NO. 22-62 AN APPROPRIATION ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR 0 BEGINNING OCTOBER 1, 2022 AND ENDING SEPTEMBER 30, 2023, IN ACCORDANCE WITH SECTION 7, ARTICLE XII OF THE CHARTER OF THE CITY OF PORT ARTHUR. A SEPARATE RATIFICATION VOTE IS REQUIRED PURSUANT TO SECTION 102.007(C) OF THE TEXAS LOCAL GOVERNMENT CODE 0 Councilmember Marks read the following motion into the record: I Make A Motion That The City Of Port Arthur Ratify The Property Tax Increase Reflected In The Budget For FY 2022-2023 As It Will Raise More Revenue From Property Taxes Than Last Year's Budget By An Amount Of $2,999,794.00 13.45% And Of That Amount $266,707.00 Is Tax Revenue To Be Raised From New Property Added To The Tax Roll This Year The motion was made by Councilmember Marks and seconded by Councilmember Frank that the above-mentioned motion be adopted. No. 7093 — An Appropriation Ordinance Approving And Adopting A Budget For The City Of Port Arthur Section 4A City Council Minutes Special Meeting — September 1, 2022 3 Economic Development Corporation For The Ensuing Fiscal Year Beginning October 1, 2022 And Ending September 30, 2023 In Accordance With Section 12.03 Of The Bylaws Of The Corporation The Mayor Pro Tern introduced the above-mentioned Proposed Ordinance. The motion was made by Councilmember Moses and seconded by Councilmember Jones that Proposed Ordinance No. 7093 be adopted. The motion was made by Councilmember Frank and seconded by Councilmember Jones that Proposed Ordinance No. 7093 be amended by adding all of the necessary changes to increase the cost of living raise from 3.5% to 4.0%. The following roll call vote was taken on the motion to amend Proposed Ordinance No. 7093: Mayor Pro Tern Holmes "Yes" Councilmember Jones "Yes" Councilmember Kinlaw "Yes" Councilmember Marks "Yes" Councilmember Moses "Yes" Councilmember Frank "Yes" The motion to amend Proposed Ordinance No. 7093 was adopted. City Council Minutes Special Meeting — September 1, 2022 4 The motion was made by Councilmember Moses and seconded by Councilmember Marks that Proposed Ordinance No. 7094 be adopted. Councilmember Frank read the following motion into the record: I Move For The Adoption Of Proposed Ordinance No. 7094 That Property Taxes Be Increased By The Adoption Of A Tax Rate Of 6.961535% Which Is Affectively An Increase Of 11.8973% In The Tax Rate The following roll call vote was taken on the motion to adopt the above-mentioned Tax Rate: Mayor Pro Tern Holmes "Yes" Councilmember Jones "Yes" Councilmember Kinlaw "Yes" Councilmember Marks "Yes" Councilmember Moses "Yes" Councilmember Frank "Yes" The above-mentioned motion was adopted. The following roll call vote was taken on the motion to adopt Proposed Ordinance No. 7094: Mayor Pro Tern Holmes "Yes" Councilmember Jones "Yes" Councilmember Kinlaw "Yes" Councilmember Marks "Yes" Councilmember Moses "Yes" Councilmember Frank "Yes" Proposed Ordinance No. 7094 was adopted becoming Ordinance No. 22-64. The caption of Ordinance No. 22-64 reads as follows: ORDINANCE NO. 22-64 AN ORDINANCE ADOPTING A TAX RATE FOR THE TAX YEAR 2022 (FISCAL YEAR OCTOBER 1, 2022 — SEPTEMBER 30, 2023) (4) P.O. No. 7095 — An Ordinance Approving The 2022 Tax Roll For The Use And Support Of The Municipal Government Of The City Of Port Arthur; And Providing For The Interest And Sinking Fund And Apportioning Each Levy For A Specific Purpose The Mayor Pro Tern introduced the above-mentioned Proposed Ordinance. The motion was made by Councilmember Moses and seconded by Councilmember Jones that Proposed Ordinance No. 7095 be adopted. The following roll call vote was taken on the motion to adopt Proposed Ordinance No. 7095: Mayor Pro Tern Holmes "Yes" Councilmember Jones "Yes" Councilmember Kinlaw "Yes" City Council Minutes Special Meeting — September 1, 2022 5 Councilmember Marks "Yes" Councilmember Moses "Yes" Councilmember Frank "Yes" Proposed Ordinance No. 7095 was adopted becoming Ordinance No. 22-65. The caption of Ordinance No. 22-65 reads as follows: ORDINANCE NO. 22-65 AN ORDINANCE APPROVING THE 2022 TAX ROLL FOR THE USE AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY OF PORT ARTHUR; AND PROVIDING FOR THE INTEREST AND SINKING FUND AND APPORTIONING EACH LEVY FOR A SPECIFIC PURPOSE IV.
