A RESOLUTION PERTAINING TO THE TERMS OF EMPLOYMENT PURSUANT TO ARTICLES V AND VII, OF THE CITY CHARTER WHEREAS, the City Council approved terms of employment with the City Attorney, per Resolution No. 10-077 on February 23, 2010 and amended by various Motions approved by City Council; and WHEREAS, pursuant to Article VII of the Charter the City of Por Arthur, the City Council shall set the compensation of the City Secretary and therefore approved terms of employment with the City Secretary, per Resolution No. 11-419 on September 20, 2011 and as further amended by various Motions approved by City Council; and WHEREAS, pursuant to Resolution 20-400, the City Council made amendments to the above-referenced resolutions as to the employment of the City Attorney and City Secretary consistent with professional wage surveys and employment research for municipal employees as conducted by the City; and WHEREAS, the City Council deems it in the best interest of the City to provide a deferred compensation plan to the above-referenced appointed officials. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Council authorizes, the Amendment to Resolution 10-077 as it pertains to the City Attorney, in substantially the same form as denoted in Exhibit"A", Section 3. That the City Council authorizes, the Amendment to Resolution 11-419 as it pertains to the City Secretary, in substantially the same form as denoted in Exhibit"B". Section 4. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. READ, ADOPTED AND APPROVED on this day of September, A.D., 2022, at a Meeting of the City Council of the City of Port Arthur, by the following vote: AYES: Mayor: Councilmembers: NOES: Thurman Bill Bartle, Mayor ATTEST: Sherri Bellard, City Secretary APPROVED AS TO FORM: 7\ Valecia R. Tizeno, ity Attorney APPROVED FOR ADMINISTRATION: Ronald Burton, City Manager EXHIBIT "A" The following changes in the terms of as set forth in Resolution No. 10-077 and all corresponding motions of the City Council are amended as follows: F. Retirement Paragraph 2 of Section F of the letter agreement will be amended to state the following: "Effective July 1, 2022, the City will contribute a bi-weekly amount equal to $20,000 per year, to a deferred compensation plan of your choice." EXHIBIT "B" The following changes in the terms of as set forth in Resolution No. 11-419 and corresponding motions of the City Council are amended as follows: F.
