Nature of Request: Renew a contract with PA Associated Contractors, LLC of Port Arthur, Texas for construction superintendent services for Port Arthur Transit's(PAT)upcoming construction projects with a projected budgetary impact of$35,035.00. Background: Per Resolution No. 21-418, PA Associated Contractors, LLC of Port Arthur, Texas was awarded a contract for construction superintendent services for Port Arthur Transit's(PAT)upcoming construction projects with a projected budgetary impact of$35,035.00,with the option to renew for two (2)additional one-year periods. Recommendation: It is recommended that the City Council approve P.R. 22772. This Resolution would authorize the City Manager to renew a contract with PA Associated Contractors, LLC of Port Arthur, Texas for construction superintendent services for Port Arthur Transit's (PAT) upcoming construction projects with a projected budgetary impact of$35,035.00, for a second year. Budgetary/Fiscal Effect: Funds available in account 401-70-530-8512-00-60-000. P.R. 22772 9/15/2022 IM RESOLUTION NO. A RESOLUTION AUTHORIZING THE SECOND YEAR (FIRST RENEWAL) OF A CONTRACT WITH PA ASSOCIATED CONTRACTORS, LLC OF PORT ARTHUR, TEXAS FOR CONSTRUCTION SUPERINTENDENT SERVICES FOR PORT ARTHUR TRANSIT'S (PAT) UPCOMING CONSTRUCTION PROJECTS WITH A PROJECTED BUDGETARY IMPACT OF $35,035.00. PROJECT TR1718, TR1317,TR114 CAP BUI WHEREAS, pursuant Resolution No. 21-418, PA Associated Contractors, LLC of Port Arthur, Texas was awarded a contract for construction superintendent services for Port Arthur Transit's (PAT)upcoming construction projects with a projected budgetary impact of $35,035.00, with the option to renew for two (2) additional one-year periods; and, WHEREAS, this is the second-year(first renewal) of the contract with PA Associated Contractors, LLC of Port Arthur, Texas. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts, and opinions in the preamble are true and correct. THAT,the City Manager is hereby authorized to renew the contract with PA Associated Contractors, LLC of Port Arthur, Texas for construction superintendent services for Port Arthur Transit's (PAT)upcoming construction projects with a projected budgetary impact of $35,035.00, for a second year(first renewal), in substantially the same form as attached hereto as Exhibit"A". WITNESSETH: That for and in cons ide ration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. Pursuant to Resolution No. 21-418, the City entered into a one (1) year contract with the option to renew for two (2) additional one-year periods. The parties hereby agree to exercise said option for the second year(first renewal). 2. The term of this Contract shall be from November 16, 2022, to November 15, 2023. The City can terminate this contract at its convenience which includes,but is not limited to, funding not being available in any budget cycle with thirty (30) days written notice. 3. The Contractor will perform work as stated in the Contract Documents. 4. The Contractor will adhere to the requirement of not paying less than the prevailing Davis Bacon Related Acts (DBRA) wage rates as specified in the Contract Documents. These rates are minimums to be paid during the life of the contract. 5. During the term of this Contract,the Contractor will furnish at his own expense all of the materials, supplies, tools, equipment, labor and other services necessary to connection therewith, excepting those supplies specifically not required of the contractor in the specifications. 6. The CONTRACTOR agrees to perform all the work described in the specifications and contract documents and to comply with the terms therein for the not to exceed amount of$35,035.00. 7. The term "Contract Documents" means and includes the following a. Agreement b. General Information * c. Specifications * d. Bid Forms * e. Addendums * f. Federal Forms * g. Notice of Award h. Notice to Proceed *These items were attached to the original letting contract. This agreement is only included in this renewal. 8. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators,successors, and assigns. 9. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by their duly authorized officials, this Agreement in(2 copies) each of which shall be deemed an original on the date first above written.
