A RESOLUTION AMENDING RESOLUTION 12-025 AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDED WATER SERVICE AGREEMENT BETWEEN THE CITY OF PORT ARTHUR AND GOLDEN PASS LNG FACILITY,LLC. WHEREAS, the City of Port Arthur and Golden Pass LNG Facility, LLC ("GPLNG") entered into that certain Water Service Agreement dated January 25, 2012 ("WSA") approved by Resolution No. 12-025; and, WHEREAS, GPLNG is currently executing an expansion project to build an export facility collocated with the import terminal; and, WHEREAS,the new export facility will cause an increased water demand and the current WSA does not allow for sufficient supply once the export facility is built; and WHEREAS, GPLNG is preparing a Public Water System ("PWS") application with the Texas Commission on Environmental Quality ("TCEQ") to be in place on the Export Terminal startup date; and, WHEREAS, a requirement of the PWS application is to include an executed service agreement/contract for water supply to the facility; and, WHEREAS, GPLNG wishes to amend the existing WSA as per Exhibit"A" and execute as it pertains to the water supply expected from the City of Port Arthur; and, WHEREAS, the amended WSA will acknowledge that the City can potentially increase the maximum limit of water supply expected from 25,000 gallons per day to 900,000 gallons per day. PR No. 22832 10/14/22 bw Page 2 of 3 NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT,the City Manager is hereby authorized and instructed to amend the existing Water Service Agreement as per Exhibit"A"with Golden Pass LNG Terminal, LLC; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
