City Council is being asked to consider an abandonment request for a2.042-acre portion of a dedicated public right-of-way,known asTerminalRoad,located in the Port Arthur Heights Addition,PortArthur,Jefferson County,Texas .
The portion of right-of-way is located north of State Highway 82(A.K.A.Dr.Martin Luther King,Jr.Drive)and east of West 17th Street.

REQUEST WITHDRAWN.ON SEPTEMBER 9, 2022, THE APPLICANT, MOTIVA ENTERPRISES, LLC, SUBMITTED A NEW APPLICATION FOR REVIEW AND ACCEPTANCE.
UTILITY ENTITIES WERE CONTACTED, AND RESPONSES WERE REQUESTED/RECEIVED AND MADE PART OF THE APPLICATION PACKET.
REAL ESTATE APPRAISAL WAS ORDERED ON SEPTEMBER 12, 2022, AND RECEIVED ON OCTOBER 18, 2022.
A PUBLIC HEARING WAS HELD BY THE PLANNING AND ZONING COMMISSION ON SEPTEMBER 19, 2022, AT 5:30 P.M.
NOTICES WERE MAILED TO ADJACENT PROPERTY OWNERS WITHIN A 200 FEET RADIUS ON SEPTEMBER 7, 2022, AS WELL AS PUBLISHED IN THE PORT ARTHUR NEWSPAPER ON SEPTEMBER 9, 2022.
THE PLANNING COMMISSION VOTED 3:0 TO RECOMMENDING APPROVAL OF SAID REQUEST.
RESOLUTION NO. 22-440 APPROVED BY CITY COUNCIL ON MARCH 17, 2022, CALLING FOR A PUBLIC HEARING.
“In consensus with the City of Port Arthur,Motiva seeks to enhance our partnershipandlong-term commitment to the success of Port Arthur and its residents through theassumptionofownership,care,custody,and control of the remaining sections ofTerminalRoadasdescribed.In partnership with the City of Port Arthur,Motiva willassumethestreetinitscurrentstate,alleviating the City from undertaking significantneededrepairs.Public safety will be improved through the elimination of public trafficthathashistoricallyburdenedCityresourcesasaconsequenceofprivatecitizeninterfaceswiththeMotivaRefineryproperty.Additionally,acquisition of this roadwaywillenableMotivatoimprovesecurityhardeningofitsperimeterasMotivacontinuestoresponsiblymeetdynamicandevolvingsecuritychallenges.The City's partnership inabandoningofTerminalRoadtoMotivawillalsoallowMotivatosecuremoreofitspropertyinacontiguousmanner,which directionally allows consideration for futuregrowthopportunitiesthatwouldbebeneficialtotheCityofPortArthur,surroundingcommunities,and Motiva.”
