Langford, Assistant City Manager— Operations/Director of Development Services RE: P.R. NO. 22817 — A resolution appointing/reappointing a member to the Planning and Zoning Commission. Introduction: This agenda item intends to seek City Council's approval of P.R. NO. 22817 appointing or reappointing a member to the Planning and Zoning Commission, pursuant to Article XI, Section I, of the Charter of the City of Port Arthur, for a five (5) year term to expire on October 30, 2027. Background: In accordance with Article XI, Section I, the City Planning and Zoning Commission shall be composed of five (5) members and appointed for a term of one, two, three, four and five years, respectively, and annually thereafter one member shall be appointed for the term of five (5) years. Members of the City Planning and Zoning Commission shall be appointed by a majority vote of the members of the City Council and may be removed for cause at any time. Currently, this position is being held by former Council member Keith Richard. Mr. Richard was first appointed to the Planning &Zoning Commission September 26, 2017, by Resolution No. 17-244 replacing long time member Richard Cox. He has diligently served on the Commission since this time. Notification of term expiration was forwarded to Mr. Richard, via text, on October 21, 2022, and via email. He was informed that City Council will vote to appoint an individual "Remember,we are here to serve the Citizens of Port Arthur" P.O.Box 1089 X Port Arthur,Texas 77641-1089 X 409.983.8101 X FAX 409.982.6743 to fill the expired term of P&Z Commissioner; however, Council can choose to reappoint him to a new five-year term, ending October 30, 2027, with his confirmation. Budget Impact: None Recommendation: It is recommended that City Council approve P.R. NO. 22817 appointing or reappointing a member to the Planning and Zoning Commission, pursuant to Article XI, Section I, of the Charter of the City of Port Arthur, for a five (5) year term to expire on October 30, 2027. A RESOLUTION APPOINTING OR REAPPOINTING A MEMBER TO THE PLANNING AND ZONING COMMISSION WHEREAS, the term of Planning and Zoning Commissioner Keith Richard expired on August 4, 2022, as delineated in Exhibit "A"; and, WHEREAS, pursuant to Section 1 of Article XI of the Charter of the City of Port Arthur, it is necessary to appoint or reappoint a person to serve the term set to begin on October 26, 2022; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1: That the facts and opinions in the preamble are true and correct. Section 2: That is appointed and/or reappointed to serve as a member of the Planning and Zoning Commission for a five (5) year term, expiring October 30, 2027, as delineated in Exhibit "B". Section 3: That the appointee shall immediately contact the City Secretary's Office and be sworn in. Section 4: That this Resolution shall be effective immediately. Section 5: That a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
