BACKGROUND:
The Planning and Zoning Commission is being asked to consider a replat request
to create a 0.8032 acre tract consisting of Lots 1 - 5, Block 466, to produce one tract
to become Tract 1-A, Block 466, from Lots 1-5, Block 466, of the Port Arthur Land
Company subdivision, Jefferson County, Texas. The property is located south of
18th Street and west of Dallas Avenue. The zoning is "HC" for heavy commercial us; it
is recommended that property owner/ or contractor prior to construction to
contact the dispatch at 409.983.8550 for locations of water & sewer. Notices were
sent out in compliance with the Texas Local Government Code Section 212.

RECOMMENDATION:
The planning staff has no objections to the approval of this replat. It meets all the
city's requirements and will allow for a church with comparable parking

BACKGROUND:
The Planning and Zoning Commission is being asked to consider an extension of 6
months as per ordinance due to the developer seeking the opportune time to continue the
subdivision as well as additional investment sponsorship. These talks are in process and
will give the developer time to prepare a final plat with housing components that are
feasible for this property and period (See letter attached)

Staff has no objections to this request considering the economy and the fact that the
owner is in talks to continue Phase III of the Tallow Woods

SUMMARY: The extension may be granted in line with Section 98 Subdivision -Article
III, Division 2, Section 98-182 subparagraph c) of the City Code that allows for an

BACKGROUND:
The Planning and Zoning Commission is being asked to consider an extension of 6
months as per ordinance due to the developer seeking the more time to complete the
infrastnzcture. Typically once these are accepted the final plat is submitted to be filed
with the County. However, the infrastructure will be bonded and the final plat will be
submitted so the developer may be vested with all the present zoning and platting codes
(See Request-attached)

RECOMMENDATION:
Staff has no objections to this request considering the economy and the fact that the
owner is willing to do a performance bond as per ordinance and continue developing the
site
BUDGETARY/FISCAL EFFECT:
A Performance Bond when prepared will be submitted to the City Manager for
acceptance and then on to Council for approval. This will ensure that the necessary
infrastructure such as: sidewalks, traffic lights, roads and any in complete drainage or
water systems will be completed if not by the developer by the City.
STAFFING/EMPLOYEE EFFECT:
None
SUMMARY: The extension may be granted in line with Section 98 Subdivision Article
III, Division 2, Section 98-182 subparagraph c) of the City Code that allows for an
extension not to exceed a year. This is for Phase I of Angel Trace all other phases will be
finaled as submitted and approved

BACKGROUND:
The Planning and Zoning Commission is being asked to consider rezoning of the existing
property such that this property may be changed from "SF" (single -family) to PD-NS
(planned development for neighborhood services -excluding educational /institutional,
amusement, temporary-permit, transportation related, commercial type, special industrial
and agricultural uses) in accordance with the schedule of uses in the Zoning Ordinance.
The acreage is approximately 3.400 acres and the property is located (north of 39`''Street
and east of Highway 366 (Atlantic Road).
The proposed zoning PD- NS (planned development for neighborhood services) is to
accommodate a bed and breakfast inn with minimal "NS" uses so as not to infringe on
the residential setting of the subdivision. Notices were sent out in compliance with the
Texas Local Government Code Section 211 and 212 as well as the publication was done
more than 15 days prior to the public hearing. However, this meeting the continued case
was mentioned for August 17, 2009 so no new notices went out. Please note listed uses
requested over page, the various departments are aware of these uses to be performed on
the property at 4400 Atlantic Road

RECOMMENDATION:
Staff has no objections to this request but the Fire Department and Building Inspections
require proper fire equipment installed prior to an occupancy permit. Public facilities and
existing utilities shall match occupancy capacity for compliance operations. Off-street
parking shall be sufficient for all activities. This is estimated about 45 spots as to
ordinance with the TAS (Texas Accessibility Standards) in enforced to allow handicap
parking

SUMMARY: The zoning should be reviewed and considered for approval noting these
uses
THE FOLLOWING USES WILL BE ALLOWED:
WEDDING RECEPTIONS AND SIMILAR PARTIES, LUNCHEONS, CHARITABLE
EVENTS AND GROUP FUNCTIONS. IN ADDITION, TO CORPORATE RECEPTIONS,
DINNERS AND SPECIAL EVENT CELEBRATIONS. THE SCOPE OF THESE EVENTS
SHALL BE IN LINE WITH PARKING AS ONLY OFF-STREET PARKING WILL BE
ALLOWED. LANDSCAPING, AND THE AESTHETIC NATURE OF THE FACILITY
SHALL BE MAINTIANED INLINE WITH SURROUNDING ESTATE PROPERTIES, SUCH
THAT THE COMMERCIAL NATURE OF THE PROPERTY DOESNOT COMPROMISE THE
RESIDENTIAL SETTING. A FOOD AND BEVERAGE LICENSE IS THE ONLY
APPLICABLE TABC OPTION THAT MAY APPLY
