ORDINANCE NO.
AN ORDINANCE ADDING ARTICLE II, DIVISION 4 (WAGE & SALARY
ADMINISTRATION) , SECTION 158 (ADDITIONAL COMPENSATION)
TO THE CODE OF ORDINANCES AND SECTION 17-72 TO THE CITY
OF PORT ARTHUR' S PERSONNEL POLICY AS IT PERTAINS TO
ADDITIONAL HOLIDAY COMPENSATION TO CITY EMPLOYEES
(REQUESTED BY COUNCILMEMBERS MARKS AND KINLAW)
WHEREAS, it is the desire of the City Council to establish a
procedure to provide additional holiday compensation to its
employees; and,
WHEREAS, in order to comply with the requirements of Article
III, Section 53 of the Texas Constitution, a City must provide for
said compensation in (1) its budget; (2) personnel policy; and (3)
offer the additional pay prior to the work being performed; and,
WHEREAS, it is deemed in the best interest of the City to add
Section 78-158 to the Code of Ordinances and Section 17-71 to the
City' s Personnel Policy to provide for a legal process for
additional holiday compensation.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
Section 1. That the facts and opinions in the preamble
are true and correct .

Section 2 . That Chapter 78 , Division 4 , Section 158 is
hereby added to the City of Port Arthur Code of Ordinance, to read
in accordance with Exhibit A, which is attached hereto.
Section 3 . That it is deemed in the best interest of the
City to add Section 158 of Code of Ordinances and Section 17-71 to
the City' s Personnel Policy to provide for a legal process to for
additional holiday compensation as delineated in Exhibit "A. "
Section 4 . That all ordinances, resolutions, or parts
thereof, that are in conflict or inconsistent with any provision
of this Ordinance are hereby repealed to the extent of such
conflict, and the provisions of this Ordinance shall be and remain
controlling as to the matters regulated, herein.
Section 5 . That should any of the clauses, sentences,
paragraphs, sections or parts of this Ordinance be deemed invalid,
unconstitutional, or unenforceable by a court of law or
administrative agency with jurisdiction over the matter, such
action shall not be construed to affect any other valid portion of
this Ordinance .
Section 6 . That the City Secretary is hereby directed to
record and publish the attached rules, regulations and policies in
the City' s Code of Ordinances as authorized by Section 52 . 001 of
the Texas Local Government Code.
Section 7 . That it is hereby officially found and
determined that the meeting at which this Ordinance was passed was
open to the public, and that public notice of the time, place and
purpose of said meeting was given as required by the Open Meetings
Act, Texas Government Code, Chapter 551 . Notice was also provided
as required by Chapter 52 of the Texas Local Government Code .
Section 8 . That a copy of the caption of this Ordinance
be spread upon the Minutes of the City Council .
Section 9 . That the ordinance shall be effective
immediately.
READ, ADOPTED AND APPROVED on this day of
A.D. , 2022 , at a Regular Meeting of the City Council of the City
of Port Arthur, Texas, by the following vote : AYES :

Personnel Policy
The City Council may authorize additional
compensation as a part of an employee's
regular earnings during the holiday season . The
authorizing ordinance must provide for said
compensation in the budget for the fiscal year
in which it is being offered . The additional
compensation must be offered to the
employees prior to the work being performed .
