Williams, Director of Human Resources RE: A Resolution Approving a Property Damage Settlement in the Amount of$64,393.53 for Damages to City of Port Arthur WW Conveyance Unit #2467 (2022 John Deere Trackhoe) Nature of the request: On September 6, 2022, Unit #2467 was being hauled on a trailer from a job site when the operator was turning under an underpass when the track hoe overturned. Beyond the weight of the unit, excessive mud on the tracks and lack of the proper restraints, caused the unit to overturn. Staff Analysis, Considerations: The City has Mobile Equipment Physical Damage insurance coverage through Texas Municipal League Intergovernmental Risk Pool (TML-IRP) with a $10,000.00 deductible. TML-IRP has offered the City a settlement of$64,393.53, less the $10,000.00 deductible, making the final settlement offer $54,393.53 (Exhibit "A" attached). Recommendation: I recommend approval of Proposed Resolution No. 22906 authorizing the property damage settlement against TML-IRP for damage sustained to WW Conveyance Unit #2467 (2022 John Deere Trackhoe). TML-IRP has offered to settle the claim for $64,393.53, less the $10,000.00 deductible, making the final offer $54,393.53. This is considered a fair and reasonable settlement. Budget Considerations: The funds received will be deposited in the Insurance Proceeds Account #410-00-000-4744-00-00-000, HINWS. "Remember we are here to serve the Citizens of Port Arthur" P.R. That, the City Manager is hereby authorized to execute settlement in the amount of $64,393.53, less the Automobile Physical Damage deductible amount of $10,000.00, making the final settlement offer $54,393.53, for the claim against TML-IRP in substantially the same form as delineated in Exhibit "A". Section 3. That, a copy of this Resolution be spread upon the minutes of the City Council.
