City of n rt rth u�r Texas INTEROFFICE MEMORANDUM WATER UTILITIES DEPARTMENT-ADMINISTRATION Date: December 2, 2022 To: The Honorable Mayor and City Council Through: Ronald Burton, City Manager From: Calvin Matthews, P.E., Water Utilities Director RE: PR No. 22892 —Execute Main Wastewater Plant (WWTP) Improvement Project Change Order No. 2 Introduction: The intent of this agenda item is to seek Council's authorization for the execution of deductive Change Order No. 2 with ALLCO, LLC of Beaumont, Texas for the rehabilitation and modification of the Main Wastewater Treatment Plant in Port Arthur, Texas with an updated projected budgetary impact of$67,335,613.43. Freese &Nichols, Inc. has submitted Change Order No. 2 for the contract with a cost increase for Primary Clarifiers subgrade stabilization, Drying Beds demo, Demo and Remove CSS, Helical Piles and Brentwood PVC TF Media price increase and reduction for the removal of VE Lighting Package, use of bank sand for pipe bedding, and remove Admin Building improvements. This Change Order No. 2 includes a 75-day time extension with a final project end date of December 17, 2026. Background: The Main Wastewater Treatment Plant is in need of major improvements. This project will include improvements to the Main Outfall Lift Station, Headworks, Primary Clarifiers and Vaults, Trickling Filters, Multipurpose Lift Station, Final Clarifiers and RAS/WAS Meter Station, Filters, Chlorine Contact Basins and Non-Potable Water System, Dewatering Building, Plant Drain Lift Station, Electrical & Instrumentation and Electrical Buildings, Mechanical Screens and Washer-Compactors. The Purchasing Division of the Finance Department advertised for bids in the Port Arthur News on November 17, 2021 and November 24, 2021, with one bid being received on January 12, 2022 from ALLCO, LLC of Beaumont, Texas. The bid amount received was $73,643,227.00 and the project was awarded to ALLCO, LLC of Beaumont, Texas by Council Resolution No. 22-147. On August 2, 2022, the City Council approved Resolution No. 22-329, approving Change Order No. 1 to the contract in the amount of ($6,234,049.00) due to value engineering performed by Freese & Nichols, Inc., ALLCO, LLC, Golden Triangle Consulting Engineers and the City of Port Arthur staff for a new contract amount of$67,409,178.00 The Main Wastewater Treatment Plant project is fully funded, with $56,237,412.00 from Account No. 404-40-000-8516-00-00-000, Project No. TW-0003-CON and $11,171,766.00 from 169-07-015-8516-00-40-000, Project No. ARP002-GRE-WWT. Budget Considerations: The total projected budgetary amount of this change order is ($73,564.57), reducing the total projected budgetary impact from $67,409,178.00 to $67,335,613.43. The Main Wastewater Treatment Plant project is fully funded, with $56,237,412.00 from Account No. 404-40-000- 8516-00-00-000, Project No. TW-0003-CON and $11,171,766.00 from 169-07-015-8516-00- 40-000, Project No. ARP002-GRE-WWT. Recommendation: I recommend City Council approve PR No. 22892 authorizing the execution of deductive Change Order No. 2 with ALLCO, LLC of Beaumont, Texas, reducing the project cost by ($73,564.57) as described/outlined above. THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to PR No. 22892 12/2/22 bw Page 2 of 3 execute Change Order No. 2 for ($73,564.57) with ALLCO, LLC of Beaumont, Texas in substantially the form as attached hereto as Attachment "A", for the rehabilitation and modification of the main Wastewater Treatment Plant in Port Arthur, Texas, to a new projected budgetary amount of$67,335,613.43 and includes a 75 day time extension with a final project end date of December 17, 2026; and, THAT, this project will be partially funded by $56,163,847.43 from a Texas Water Development Board (TWDB) loan and charged to Account No. 404-40-000-8516-00-00-000, Project No. TW-0003-CON; and, THAT, the balance of $11,171,766.00 will be funded through an ARPA Grant and charged to 169-07-015-8516-00-40-000, Project No. ARP002-GRE-WWT; and, THAT, such funds shall be used only to make payments as required under this contract; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Item No. 1: Demo and Remove Existing Concrete Drying Beds and Clay Pipes In order to install Primary Clarifier A per the plans,Allco had attempted to excavate the area and they discovered that there were abandoned concrete drying beds. The only option was to demolish and remove the concrete drying beds and associated clay pipes.Allco submitted CP-002 for this unforeseen condition with a total cost of $33,735.83 and 14 Calendar Days extension. Freese and Nichols, Inc. agrees with their proposed cost and time extension. This work has been completed. Total Cost: $33,735.83 Additional Days: 14 Calendar Days Item No. 2: Primary Clarifier A Unstable Subgrade Removal and Replacement After removal of the concrete drying beds (Item No. 1), it was discovered that the subgrade consisted of a mix of sand and gravel up to 4 feet below the surface. This sand and gravel mix could not bear the weight of the construction equipment driving over it and was deemed unstable. Freese&Nichols,Inc.and Arceneaux Wilson&Cole explored several options to stabilize the subgrade, but the most economical option was to remove the unstable material and replace it with imported select fill material. Allco submitted CP-001 for this unforeseen condition with a total cost of$99,104.00 and 75 Calendar Days extension.Freese and Nichols,Inc.agrees with their cost but at this moment can only recommend 42 Days.This work has been completed. Total Cost: $99,104.00 Additional Days:42 Calendar Days Item No. 3: Removal of Cement Stabilized Sand Surrounding Existing Primary Clarifier C During the demolition of Primary Clarifier C, it was discovered that the outer walls were encased with Cement Stabilized Sand. Due to the strength of the Cement Stabilized Sand it took a considerable amount of effort by Allco to remove and they submitted CP-003 with a proposed cost of $29,752.00 and 10 Calendar Days extension. Freese and Nichols, Inc. agrees with their proposed cost and time extension.This work has been completed. Total Cost: $29,752.00 Additional Days: 10 Calendar Days PTR22379 T:\4.0 CONSTRUCTION\4.40 Contract Mod\4.43 Chg Orders\Change Order No.2 Item No.4:Shared Cost for Helical Piles Price Escalation Steel prices continue to experience a cost increase due to external factors.The material cost for the Helical Piles had increased from the base bid price by$323,955.20. In order to stop any further escalation in price, and out of good faith, Allco paid a significant down payment to lock in the price. A meeting was held between the City of Port Arthur and Allco where it was agreed upon that the cost increase would be shared among the two. Total Cost: $161,977.60 Additional Days:0 Calendar Days Item No. 5: Brentwood Optimized Trickling Filter PVC Media with Cover While exploring value engineering options, CE Shepherd was chosen for the Trickling Filters PVC Media which resulted in a credit of($298,000.00).This credit was included in Change Order No. 001.Allco was recently contacted by CE Shepherd and informed that they would no longer be able to honor that price. Allco requested updated pricing from other manufacturers and Brentwood offered an optimized PVC Filter Media with Protective Cover, which would allow plant staff to walk on it to service the spraying arms, for $810,000.00. While this cost is lower than the base bid, it would be an increase to balance out what was credited in Change Order no. 001. Cost breakdown is as follows: Trickling Filter Media Cost Balance Brentwood (Base Bid) $987,500.00 CE Shepherd (CO-001 VE) $689,500.00 $ (298,000.00) Brentwood Optimized $810,000.00 $ 120,500.00 Total Cost: $120,500.00 Additional Days: 0 Calendar Days Item No. 6:Value Engineering Lighting Package Revised Pricing While exploring Value Engineering options, Freese & Nichols, Inc. coordinated with W-Industries (Electrical Sub) to find areas where project costs could be optimized. The initial VE Package that W-Industries provided had to be revised and was not included in Change Order No. 001. Their updated VE Package has been reviewed by Freese&Nichols, Inc. and is recommended with a cost savings of($74,792.00). Total Cost: ($74,792.00) Additional Days: 0 Calendar Days Item No. 7:Switch Pipe Embedment from Class 3 & 10 Aggregate to Bank Sand As a Value Engineering option, Allco had proposed replacing the encasement material for pipes where the contract documents called for Class 3 & Class 10 aggregate to select fill. Freese & Nichols, Inc. investigated Allco's proposal and decided that select fill is not viable for pipe encasement. While looking into this option, Freese & Nichols, Inc.'s structural team recommended Bank Sand as an alternative to Class 3 & Class 10 aggregate. The TxDOT specifications for Bank Sand was provided to Allco and they provided pricing that would credit the project with ($254,390.00). Total Cost: ($254,390.00) Additional Days:0 Calendar Days [PTR22379]T:\4.0 CONSTRUCTION\4.40 Contract Mod\4.43 Chg Orders\Change Order No. 2 Item No. 8: Remove Alternate Bid Item D-08 Administration Building While looking at options to reduce project costs and balance out payment for Items 1 through 5 of this Change Order, it was decided to remove the Alternate Bid Item consisting of the improvements to the Administration Building. This activity was scheduled to be started towards the end of the project and the City of Port Arthur reserves the right to re-add this Alternate Bid Item to the project at a later date. The City of Port Arthur also has the option to deduct the duration of this alternate bid item that Allco has designated for it on their baseline schedule from the contract time. Total Cost: ($189,452.00) Additional Days:0 Additional Days. Item No. 9:Abnormal Weather Days from NTP (6/22/2022)through November: 9 Days. The contract documents designate a fixed amount of "Anticipated Bad Weather Delays" per a given month and when the number of"Bad Weather Days", where rain "equals or exceeds 0.25 inches", go over the "Anticipated Bad Weather" days, that is defined as an "Abnormal Weather Condition" and "the contractor is entitled to an equitable adjustment in the Contract Times". From the date of the Notice to Proceed,June 6, 2022, up through the month of November, 2022, the project has experienced 9 Abnormal Weather Days. Total Cost: $0.00 Additional Days: 9 Calendar Days To summarize, this Change Order No. 002 has an overall cost reduction of ($73,564.57) and a contract time extension of 75 days. Following the proposal, our base bid price was held additionally for 30 days with the expectation that the project would begin shorty after. We were unable to secure raw materials at the February market price. The steel market has been in on an upward trend since quarter one 2022. It is expected to continue to rise throughout the year with other premium cost related to our industry such as welding materials, supplies, labor, etc. Attached is supporting documentation. Inflation has had a tremendous pressure on the price of steel. For these reasons there has been a 20% price increase from our base bid price effective on all orders received after June 1st,2022. Below is a summary of my understanding of their proposal: • The original design specified PVC as the type of material for the trickling filter media and required a bearing capacity of 40 pounds per square foot (PSF) per foot of media height or 1,000 PSF, whichever is greater(this is for the top and bottom media layer). Because of the shallow depth of the trickling filter, 1,000 PSF will be the governing criteria which is pretty conservative. • Brentwood's alternate design reduces the bearing capacity from 1,000 PSF to 640 PSF for the top layer and 700 PSF for the bottom layer. This will still meet the industry standard of 40 PSF per foot of media height. Additionally, Brentwood will be supply their protective grating for the entire surface of the filter.This grating will allow the operator to walk the entire surface of the filter and also provide some UV protection for the media. See email below from Danny.The plant currently has only a narrow access walkway that has the grating. With the new media there will be grating over the whole surface. In my opinion, the optimized design proposed by Brentwood is acceptable.The lower bearing capacity which results in thinner gauge for the media does not compromise the structural integrity of the media. Additionally, the protecting grating over the entire surface of the filter will provide additional protection for the media. Below is a cost comparison of the all the trickling media options provided by Allco. With change order no. 1 we changed the media type to CE Shepherd's PP and took a cost credit of$298,000 which is no longer available.
