No. 15454 adopting the purchasing procedures of Section 271.9051 as amended by House Bill 2082 of the Local Government Code as to give local bidders a preference when they are within 5~ of the lowest bid price as to non- federally funded projects under $100,000. A RESOLIITION ADOPTING THS PIIRCHASING ' PROCEDIIRSS OF SECTION 271.9051 A3 AMENDED BY HOIISS BILL 2082 OF THE LOCAL GOVERNMENT CODE A3 TO GIVE LOCAL BIDDERS A PREFERENCE WHEN THEY ARE WITHIN 5$ OF THE LOWEST BID PRICE AS TO NON-FEDERALLY FIINDSD PROJECTS IINDER $100,000 WHEREAS, Section 271.9051 as amended by H. B. 2082 of the Local Government Code allows an eligible City to award a contract to a local bidder if the bid is within 5~ of the lowest bid price for projects under $100,000; and WHEREAS, the City Council deems it in the public interest to have this option in all of its purchasing transactions, except for federally funded projects. NOW THEREFORE, BS IT RESOLVED BY THS CITY COIINCIL OF THS CITY OF PORT ARTHDR, TESAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That for expenditures of less than $100,000 on non-federally funded projects, the City's Purchasing Manager shall notify bidders that the City or its affiliated entities will either award the contract to: 1) the lowest responsible bidder; or 2) the bidder who is within 5~ of the lowest bid and whose principle place of business is in the City of Port Arthur, if the City Council determines, in writing, that the local bidder offers the City of Port Arthur or Z.pr14578 its affiliates the best combination of contract price and additional economic development opportunities for the City of Port Arthur created by the contract award, including the employment of Port Arthur residents and increased tax revenues to the local government; or 3) reject the bids. Section 3. That Resolution No. 08-071 is herein repealed. Section 4. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
