HomeMy WebLinkAboutPO 6028: RENE BATES AUCTIONEERS ONLINE AUCTIONMemorandum City of Port Arthur, Texas Purchasing Deparhnent TO: Stephen Fitzgibbons, City Manager FROM: Shawna Tubbs, Purchasing Manager DATE: August 20, 2009 SUBJECT: Proposed Ordinance No. 6028 RECOMMENDATION The Purchasing Division recommends the City Council adopt Proposed Ordinance No. 6028 amending Ordinance No. 09-56 for Rene Bates Auctioneers, Inc. of McKinney, Texas to sell assorted furniture/minorequipmmt, vehicles, equipment, or heavy equipment surplus which has become obsolete and/or non-functional at an on-line auction. BACKGROUND There is a need to amend the Ordinance No. 09-56 for Rene' Bates Auctioneers, Inc. of McKinney, Texas, to include three (3) additional vehicles/equipment that need to be placed on the auction list. BUDGETARY/FISCAL EFFECT The net proceeds of the sale, after Auction expenses, will be credited to the Equipment Replacement Fund. STAFFING EFFECT N/A SUMMARY The Purchasing Division recommends the City Council adopt Proposed Ordinance No. 6028 amending Ordinance No. 09-56 for Rene Bates Auctioneers, Inc. of McKinney, Texas to sell assorted fumiturelminor equipment, vehicles, equipment, or heavy equipment surplus which has become obsolete and/or non-functional at an on-line auction. AN ORDINANCE AMENDING ORDINANCE NO. 09-56 AS TO THE SALE OF SURPLUS ASSORTED FURNITURE/MINOR EQUIPMENT, VEHICLES, EQUIPMENT, OR HEAVY EQUIPMENT FOR THE CITY OF PORT ARTHUR AT A PUBLIC ONLINE AUCTION. WHEREAS, Ordinance No. 09-56 authorizing a contract with Rene' Bates to conduct an online auction of City Surplus of assorted furniture/minor equipment, vehicles, equipment, or heavy equipment surplus equipment was approved at the Council meeting on August 11, 2009; and WHEREAS, there is a need to include an additional three (3) vehicles/equipment to the Auction List as delineated in Exhibit "A "; and WHEREAS, it has been determined that it would be in the best interest of the City to sell the said property at an online auction to obtain the best possible price. NOW, THEREFORE BE IT ORDAINED BY THE CITY OF PORT ARTHUR: Section 1. That the City Council authorize the amending of Ordinance No. 09-56, to include three (3) additional vehicles/equipment in the auction. Section 2. That the City Manager, together with Shawna Tubbs, Purchasing Manager, are hereby authorized, pursuant to Article XIV, Section 7 of the Charter of the City of Port Arthur, to sell the above named surplus property at an online auction said property being shown in detail as delineated in Exhibit "A "attached hereto and made a part hereof. Section 3. That the above named City officials be and are hereby authorized and empowered to execute and deliver bills of sale or other instruments necessary to transfer P O 6023 -2- title to said items at the price bid, in a form to be approved by the City Attomey. Section 4. That this being an Ordinance not requiring publication the same shall take affect and be in force immediately from and after its passage. Section 5. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Council.
