NO. 22959 —A resolution authorizing the City Manager to reject bids for the El Vista and Port Acres Drainage Improvement Projects. Introduction: This Agenda Item intends to request authorization for the City Manager to reject bids documents submitted for the El Vista Subdivision and Port Acres Subdivision drainage improvement projects funded by the Federal Emergency Management Agency's Hazard Mitigation Grant Program (HMGP) and the Community Development Block Grants — Disaster Recovery Grant Program (CDBG-DR). Following Councils approval of this agenda item, the City Manager will authorize the Purchasing Division to re-bid the projects following mandatory federal and state procurement mandates. Background: On March 26, 2019, City Council authorized the filing of a grant application with the Texas General Land Office in the amount of $11,294,842.12 for the Hurricane Harvey Infrastructure Community Development Block Grant — Disaster Recovery (CDBG-DR) program. The Southeast Texas Regional Planning Commission (COG) was charged with establishing a method of distribution for the disaster funding in which Port Arthur was allocated said funding as part of that method. The City Manager was authorized by City Council in 2018 to apply for a Harvey Disaster Hazard Mitigation Grant through the Texas Division of Emergency Management (TDEM) in the amount of $36,758,150.00. The Resolution was amended on July 16, "Remember,we are here to serve the Citizens of Port Arthur" P.O. Box 1089 X Port Arthur,Texas 77641-1089 X 409.983.8101 X FAX 409.982.6743 2019, through Resolution No. 19-290, increasing the grant amount to $38,790,630.00 with a potential grant award of 75% project cost and a grant match requirement of up to 25% of the total project cost, with the match being funded through the CDBG-DR grant allocation. The subject projects were let or presented for bid in September 2022, with bids opened in October 19, 2022. Upon receipt of bids, the City was met with the stunning result that the projects bids totaled $17 Million more than the original project estimate. Certainly, lingering supply chain issues.compounded by the impact of continually rising inflation had an impact, as expected, on the bid prices, but the final number was well beyond any reasonable estimate. Given the importance of these projects to the City Council, the citizens, and the staff, an immediate effort was made to determine how the funding gap might be closed. City staff, in conjunction with members of the Ardurra Group, engaged in a herculean effort to find available funding. A request was submitted to reallocate available G.L.O., FEMA, and CDBG-DR funding to cover the project deficit. This re-allocation requires the approval of the funding entities. The difficulty was further compounded by the fact that the bids expire 60 days after bid opening, in accordance with state law. . In the interim, the staff provided the Law Department with the agenda items in preparation for awarding the bids should the funding gap be closed. As both processes proceeded, we continued to be optimistic that we could achieve the goal of funding and awarding the El Vista and Port Acres Drainage projects. Although both projects have received favorable nods from the funding entities, and the funding re-allocations are far along in the funding pipeline, the City has not received final approval of the funding re-allocation. Further, senior staff has been working with the Law Department regarding the shifting landscape of federal procurement . As we work with existing funding, such as CDBG, and new funding, such as ARPA, the rules regarding procurement vary. Critical to any audit review is the procurement process through which the bid pricing was obtained. After senior staff, the Purchasing Manager, and the Law Department staff reviewed the procurement process, we agreed on the need for revise the invitation to bid based on the various funding sources expected to be involved in the funding of these projects. Based on the fact that the Cityhas not received the final and official approval of the pp funding re-allocation, and we want the procurement process to be unquestionable and fully compliant, I recommend that the City reject the bids received on October 19, 2022 and rebid the El Vista and Port Acres Drainage Projects. Budget Impact: Not yet determined. Recommendation: It is recommended that City Council approve P.R. No. 22959, authorizing the City Manager to reject bids documents submitted for the El Vista Subdivision and Port Acres Subdivision drainage improvement projects funded by the Federal Emergency Management Agency's Hazard Mitigation Grant Program (HMGP) and the Community Development Block Grants — Disaster Recovery Grant Program (CDBG-DR), and authorize the Purchasing Division to re-bid the projects following federal and state mandates. A RESOLUTION REJECTING THE BIDS SUBMITTED FOR THE EL VISTA SUBDIVISION AND PORT ACRES SUBDIVISION DRAINAGE IMPROVEMENT PROJECTS AND AUTHORIZING THE PURCHASING DIVISION TO RE-ADVERTISE THE INVITATIONS TO BID. WHEREAS, the City of Port Arthur obtained funding from Hazard Mitigation Grant Program (HMGP) and Community Development Block Grant — Disaster Recovery (CDBG-DR) to fund the El Vista Subdivision and Port Acres Subdivision Drainage Improvement Projects; and, WHEREAS, the City of Port Arthur advertised for bids in the Port Arthur News on September 10, 2022, and September 17, 2022, for Phase 2 Construction of the El Vista Subdivision and Port Acres Subdivision Drainage Improvement Projects under Bid #P22- 088 and P22-089, as delineated in Exhibit "A"; and, WHEREAS, the City received two (2) bids for the above referenced projects, as delineated in Exhibit "B", and were opened on October 19, 2022, at 3:15 p.m.; and, WHEREAS, upon receipt of bids, the costs totaled $17 Million more than the original project estimates. Therefore, a request was submitted to the funding entities to reallocate available G.L.O., FEMA, and CDBG-DR funding to cover the project deficit; and, WHEREAS, at this time, the City is awaiting formal written final approval of the funding re-allocation; and, P.R. NO.22959 12/29/2022 PDL Page 2 of 11 WHEREAS, the federal programs funding the Drainage Improvement Projects also require compliance with federal and state mandated clauses such as Davis-Bacon, 2 CFR Part 200, HUD Section 3, and other federal and state clauses; and, WHEREAS, upon review, it was determined that the bid documents for the subject projects require revision to strictly comply with procurement and contract requirements for the Federal Emergency Management Agency's Hazard Mitigation Grant Program (HMGP) and the Community Development Block Grant — DR (CDBG-DR); and WHEREAS, Texas Local Government Code §252.043 (f) provides that the governing body of the City may reject any and all bids. Therefore, it is requested that the City Council reject all bid proposals and advertise a revised invitation to bid; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the facts and opinions in the preamble are true and correct. THAT the City Council hereby rejects the October 19, 2022 bids and authorizes the Purchasing Division to re-advertise a revised invitations to bid for both of these projects.
