Background: To comply with the Texas Commission on Environmental Quality's (TCEQ) regulations and permit, the leachate at the Landfill must be extracted and adequately disposed. The Landfill's need for Wastewater Transport Service's (WWTS) services for leachate extraction and hauling was required to prevent environmental, health, and safety concerns to ensure compliance with TCEQ's mandates. Budget Impact: Funds are available in the Landfill's Other Contractual Service Account, account number 403-50-320- 5470-00-00-000. Recommendation: It is recommended that the City of Port Arthur's City Council approve the payment for emergency leachate hauling at the Landfill to Wastewater Transport Service for$25,563.82. A RESOLUTION APPROVING PAYMENT FOR EMERGENCY LEACHATE HAULING AT THE LANDFILL BY WASTEWATER TRANSPORT SERVICE OF BEAUMONT, TEXAS, FOR $25,563.82. FUNDS ARE AVAILABLE IN THE PUBLIC WORKS - LANDFILL OTHER CONTRACTUAL SERVICE ACCOUNT, ACCOUNT NUMBER 403-50-320-5470-00-00-000. WHEREAS,to comply with the Texas Commission on Environmental Quality's (TCEQ) regulations and permit, the leachate at the Landfill must be extracted and adequately disposed; and, WHEREAS, the company's services were required to ensure compliance with TCEQ's mandates and to prevent environmental,health, and safety concerns; and, WHEREAS,Wastewater Transport Services billed the City$25,563.82 for the emergency leachate hauling services as delineated in Exhibit A; and, WHEREAS, this payment is authorized pursuant to Section 252.022(a)(2) of the Texas Local Government Code where payment is necessary to preserve or protect the public health or safety of the municipality's residents is authorized; now,therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT,the facts and opinions in the preamble are true and correct; and, THAT,the City Council of the City of Port Arthur hereby ratifies the payment of leachate hauling from the Landfill by Wastewater Transport Service of Beaumont, Texas, for $25,563.82; and, THAT, funding is available in the Public Works-Landfill's Other Contractual Service Account, account number 403-50-320-5470-00-00-000; and, PR 22712 02/02/2023 FCR Page 2 of 3 THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
