R. No. 23007 authorizing the City Manager to execute a contract with Preferred facilities Group —USA of Beaumont, Texas for the repairs to the South Pedestrian Bridge at the Babe Zaharias Golf Course with a projected budgetary impact of$124,020.67. Background: The City of Port Arthur's Babe Zaharias Golf Course South Bridge is in need of repair and must meet the American Disabilities Act federal requirements and maintain structural integrity of a pedestrian bridge. The proposed improvements include total replacement of the subdeck, surface deck and hand rails pedestrian bridge. Budget Impact: Funds are available in the following account: 103-25-065-8526-00-20-000, Golf Course Fund Account Recommendation: It is recommended that the City Council approve P.R.No.23007 authorizing the City Manager to execute a contract with Preferred facilities Group—USA of Beaumont,Texas for the repairs to the South Pedestrian Bridge at the Babe Zaharias Golf Course with a projected budgetary impact of$124,020.67. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH PREFERRED FACILITIES GROUP — USA, OF BEAUMONT, TEXAS FOR THE REPAIRS TO THE SOUTH PEDESTRIAN BRIDGE AT THE BABE ZAHARIAS GOLF COURSE, THROUGH THE CHOICE PARTNERS PURCHASING PROGRAM, CONTRACT NO. 20/017MR-17 WITH A PROJECTED BUDGETARY IMPACT OF $124,020.67. FUNDING AVAILABLE IN GOLF COURSE FUND ACCOUNT 103-25-065-8526-00-20-000 WHEREAS, the City is obligated to meet federal, state and local American Disabilities Act, (ADA)requirements for all pedestrian facilities; and, WHEREAS, the structural integrity and surface of the south pedestrian bridge at the Babe Zaharias Golf Course is in desperate need of repair; and, WHEREAS, pursuant to Chapter 271, Subchapter D, of the Local Government Code, a city may participate in cooperative purchasing programs, such as the Choice Partners Purchasing Program Contract No. 20/017MR, as an alternative to a formal bid process; and, WHEREAS, per Resolution No. 18-445, the City of Port Arthur entered into an interlocal agreement for cooperative purchasing with the Choice Partners Purchasing Program as an alternate to the formal bidding process; and, WHEREAS, Preferred Facilities Group — USA of Beaumont, Texas, as a participating member of the Choice Partners Purchasing Program has submitted a quote for the South Pedestrian Bridge Repair at the Babe Zaharias Golf Course with a budgetary impact of $124,020.67 under Contract No. 20/017MR-17. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. P. R.No. 23007 02/27/2023 ca Section 2. That the City Council hereby authorizes the City Manager to execute a contract, in substantially the same form, attached hereto as Exhibit "A", with Preferred Facilities Group—USA of Beaumont, Texas for the South Pedestrian Bridge Repair at Babe Zaharias Golf course with a projected budgetary impact of$124,020.67. Section 3. That approval of this Resolution shall be contingent upon the approval of a budget amendment via adoption of Proposed Ordinance 7127. Section 4. R.No. 23007 5/15/2022 ca EXHIBIT "A" p• CONTRACT FOR SOUTH PEDISTRIAN BRIDGE REPAIRS AT BABE ZAHARIAS GOLF COURSE THIS AGREEMENT, made this day of , 2023 by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY" and Preferred Facilities Group — USA hereinafter called "CONTRACTOR". WITNESSED: That for and in consideration of the payments,terms, conditions, and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. The terms of this Contract shall be from date stated in the Notice to Proceed, until May 31, 2023 unless sooner terminated under the provision hereof. The City can terminate this contract at its convenience which includes, but not limited to, funding being available in any budget cycle with thirty(30) days written notice. 2. Pursuant to Choice Partners JOC Texas Contract Number 20/017MR-17, the Contractor will perform the scope of services as delineated in Exhibit"A"of the Resolution. 3. During the term of this Contract, the contractor will furnish at his own expense all of the materials, supplies, tools, equipment, labor and other services necessary to connection therewith, expecting those supplies specifically not required of Contractor in the specifications. 4.
