Williams, Director of Human Resoucees0 RE: A Resolution Approving a Property Damage Settlement in the Amount of$164,672.00 for Damages to a City of Port Arthur Traffic Cabinet (Gulfway Drive and Bluebonnet) Nature of the request: On December 4, 2020, a citizen failed to drive in a single lane, left roadway and struck an electrical pole causing it to break in half. The impact caused damage to the city's traffic control box and the components associated with the signal light. Staff Analpsis, Considerations: The City of Port Arthur has Physical Damage insurance coverage through Texas Municipal League Intergovernmental Risk Pool (TMLIRP) with a $5,000.00 deductible. TML has offered the City a settlement of$164,672.00, less the $5,000.00 deductible making the final settlement offer $159,672.00 (Exhibit "A" attached). This amount will cover a portion of the repairs to the estimated property damages for the traffic controller cabinet and signal. If additional damages are discovered, TMLIRP may issue a supplemental payment. Recommendation: I recommend approval of Proposed Resolution No. 23033 authorizing the property damage settlement against TML for damage sustained to the traffic controller cabinet. TMLIRP has offered to settle the claim for $164,672, less the $5,000.00 deductible making the final settlement offer $159,672.00. This is considered a fair and reasonable settlement to cover a portion of the repairs. Budget Considerations: The funds received will be deposited in the account. 001-00-000- 4744-00-00-000, HINGF. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE SETTLEMENT OF A PHYSICAL DAMAGE CLAIM IN THE AMOUNT OF $164,672.00 MADE AGAINST TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TMLIRP) AS A RESULT OF PROPERTY DAMAGE TO A TRAFFIC SIGNAL ON GULFWAY DRIVE AND BLUEBONNET WHEREAS, on December 4, 2020, a citizen failed to drive in a signal lane, left the roadway, struck an electrical pole causing damage to an electrical pole; and, WHEREAS, as a result of the damage, a claim was filed with Texas Municipal League Intergovernmental Risk Pool (TMLIRP) for the cost of repairs; and, WHEREAS, TML has offered to settle the claim for $164,672.00, less the Physical Damage deductible amount of $5,000.00 making the final settlement offer $159,672.00, which is considered a fair and reasonable settlement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That, the facts and opinions in the preamble are true and correct. Section 2. That, the City Manager is hereby authorized to execute settlement in the amount of $164,672.00 less the Physical Damage deductible amount of $5,000.00 making the final settlement offer $159,672.00, for the claim against TML in substantially the same form as delineated in Exhibit "A". Section 3. That, a copy of this Resolution be spread upon the minutes of the City Council.
