RE: An Ordinance Approving a Property Damage Settlement in the Amount of$19,375.00, for
Damages to City of Port Arthur Police Vehicle#2057
Nature of the request: On July 29, 2022, two Port Arthur Police Department officers were involved
in a motor vehicle accident at 2900 Turtle Creek Drive with a drunk driver. The driver was intoxicated and
disregarded a stop sign at the location of the incident.
Staff Analysis, Considerations: The City has Physical Damage insurance coverage through Texas
Municipal League Intergovernmental Risk Pool (TMLIRP) with a $2,500.00 deductible. TML has offered
the City a settlement of $19,375.00, less the $2,500.00 deductible, making the final settlement offer
$16,875.00 (Exhibit "A” attached). This amount is sufficient to cover all estimated property damages for
Vehicle #2057; however, there is an ongoing subrogation against the at fault driver's insurance company,
Progressive County Mutual. Funds received from Progressive County Mutual will be dispersed in the
proper account when received. If additional damages are discovered, TMLIRP may issue a supplemental
payment as well.
Recommendation: I recommend approval of Proposed Ordinance No. 7129 authorizing the property
damage settlement against TMLIRP for damage sustained to Police Vehicle #2057 (2015 Chevrolet Tahoe
SV). TMLIRP has offered to settle the claim for $19,375.00, less the $2,500.00 deductible, making the
final settlement offer$16,875.00. This is considered a fair and reasonable settlement.
Budget Considerations: The funds received will be deposited in the General Fund Insurance
Proceeds Account#001-00-000-4744-00-00-000, H I NGF.

RESOLUTION NO.
AN ORDINANCE AUTHORIZING THE CITY MANAGER
TO EXECUTE SETTLEMENT OF A PHYSICAL DAMAGE CLAIM
IN THE AMOUNT OF $19,375.00 MADE AGAINST
TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TMLIRP)
AS A RESULT OF PROPERTY DAMAGE TO POLICE VEHICLE #2057
WHEREAS, on July 29, 2022, Police Vehicle #2057 (2015 Chevrolet Tahoe) was
damaged when the operator was involved in an accident with a drunk driver; and,
WHEREAS, as a result of the damage, a claim was filed with Texas Municipal
League Intergovernmental Risk Pool (TMLIRP); and,
WHEREAS, TMLIRP has offered to settle the claim for $19,375.00, less the Physical
Damage deductible amount of $2,500.00, making the final settlement offer $16,875.00,
which is considered a fair and reasonable settlement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR, TEXAS:
Section 1. That, the facts and opinions in the preamble are true and correct.
Section 2. That, the City Manager is hereby authorized to execute settlement in the
amount of $19,375.00, less the Physical Damage deductible amount of $2,500.00, making
the final settlement offer $16,875.00, for the claim against TMLIRP in substantially the
same form as delineated in Exhibit "A".

Section 3. That, a copy of this Resolution be spread upon the minutes of the City
Council.
