RESOLUTION NO.
A RESOLUTION AUTHORIZING THE RIGHT OF USE BY COMMUNITY
DEVELOPMENT PROPERTIES,PORT ARTHUR,INC. FOR THE USE OF
A PORTION OF THE UNIMPROVED RIGHT-OF-WAY BETWEEN
MOBILE AVENUE AND ATLANTA AVENUE
WHEREAS, the Community Development Properties, Port Arthur, Inc. has requested a
"right of use" agreement to use a portion of the unimproved right-of-way between Mobile Avenue
and Atlanta Avenue in Port Arthur, Texas as shown on Exhibit"A" attached hereto; and
WHEREAS, Community Development Properties, Port Arthur, Inc. has expressed a need
and has requested permission for the City of Port Arthur to allow for the use of the portion of the
unimproved right-of-way shown on Exhibit"A"; and
WHEREAS, Community Development Properties,Port Arthur,Inc. has requested that the
City Council to approve this resolution allowing use of the portion of the unimproved right-of-way
shown on Exhibit"A"knowing that such resolution will be recorded in the Official Public Records
of Jefferson County, Texas; and
WHEREAS,that as a condition of and in consideration thereof,the City retains general right
of way, utility, and drainage easements for the benefit of the City of Port Arthur and other utilities
which have or will have facilities located therein. It is specifically provided that should it be
determined at any time in the future that ingress and/or egress access is necessary by the City,other
public utilities or their respective agents for necessary maintenance,replacement,relocation,repair
and all other rights incidental to and necessary in connection with said retained rights,the respective
utility will not be responsible for damages of any kind or nature by reason of said maintenance or
repairs. It is particularly understood that as a condition of the approving of any"right of use" that
there will not be created any burden or liability of any kind or nature with regard to the use made of
the right-of-way premises; and
WHEREAS,Community Development Properties,Port Arthur,Inc.agrees to the conditions
set out herein as evidenced by the signature below.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR,TEXAS:
Section 1. That after review and consideration of the above request of Community
Development Properties, Port Arthur, Inc. and the above recitals which are found to be true and
correct,adopted and incorporated herein,and for and in consideration of such requests and recitals,

permission is hereby granted for the use of the portion of the unimproved right-of-way shown on
Exhibit"A"in accordance with a copy of said drawing attached as Exhibit A,for all purposes with
the full understanding that such permissions do not constitute an abandonment of any City rights or
interest. Should the City or its agents require ingress or egress access as herein above provided to
perform any kind of work or activity related to the right-of-way of which the use of said right-of-way
by the City of Port Arthur or any agent will not create any burden or liability of any kind or nature.
Section 2. That in consideration of the City of Port Arthur allowing such"right of use",
Community Development Properties, Port Arthur, Inc., its successors or assigns do agree that this
resolution shall be placed of record in the Official Public Records of Jefferson County, Texas as
notice to all parties of interest and the public as a covenant running with the land.
Section 3. That there shall be no changes or modifications to the Improvement within the
"right of use"premises without prior approval by the City of Port Arthur.
Section 4. That the Community Development Properties,Port Arthur,Inc.shall keep the
"right of use"premises clear of obstructions and shall insure that the right-of-way is accessible.
Section 5. That this consent to"right of use"shall not be assigned or conveyed to any
other person without the written consent of the City.
Section 6. That the City of Port Arthur may, at the sole discretion of its City Council,
require that the"right of use",or any part thereof,allowed by this Agreement be removed or altered.
Section 7. That the approval of the"right of use"is limited to the"right of use"premises
and does not authorize any structures to encroach into the said"right of use"premises.
Section 8. That it is hereby officially found and determined that the meeting at which this
resolution is passed,is open to the public as required by law and that public notice of the time,place
and purpose of said meeting was given as required.
READ,ADOPTED AND APPROVED on this day of March A.D., 2023, at a
Regular Meeting of the City Council of the City of Port Arthur, Texas,by the following vote:
