RE: P.R. NO. 23078 — A resolution appointing a member of members to the
City of Port Arthur Animal Advisory Board
Introduction:
This agenda item seeks the City Council's approval of P.R. NO. 23078 appointing a
member or member(s) to the City of Port Arthur Animal Advisory Board.
Background:
On February 21, 2012, City Council approved Resolution No. 12-081, establishing the
City of Port Arthur Animal Control Advisory Board and appointing members to the board.
The establishment of the Board is in accordance with Section 823.005 of the Texas
Health and Safety Code, which states the governing body of a county or municipality in
which an animal shelter is located shall appoint an advisory committee to assist in
complying with the requirements of this chapter. The committee shall consist of a
licensed veterinarian, a county or municipal official, a person whose duties include the
daily operation of an animal shelter, and a representative from an animal welfare
organization. The advisory committee is required to meet a minimum of three times a
year.
Each member shall serve a two-year term and immediately contact the Office of the
City Secretary upon appointment to be sworn in.
The expiration date for March 30, 2023, appointments shall be March 30, 2025.

Recommendation:
City Council is recommended to approve P.R. NO. 23078 appointing a member or
member(s) to the City of Port Arthur Animal Advisory Board, providing a term expiration
of March 30, 2025.

RESOLUTION NO.
A RESOLUTION APPOINTING AND/OR REAPPOINTING A MEMBER
OR MEMBER(S) TO THE CITY OF PORT ARTHUR ANIMAL ADVISORY
BOARD
WHEREAS, the State of Texas Health and Safety Code, Title 10, Section 823.005
requires that the City of Port Arthur's governing body establish an Animal Control Advisory
Board and appoint its members to help assist in complying with the requirements of
Chapter 823: Animal Shelters, as delineated in Exhibit "A"; and,
WHEREAS, in accordance with Section 823.005 of the Health and Safety Code,
membership to the Board shall consist of one (1) licensed veterinarian, one (1) county or
municipal official, one (1) person whose duties include the daily operation of an animal
shelter, and one (1) representative from an animal welfare organization. The advisory
committee shall meet a minimum of three times per year; and,
WHEREAS, pursuant to Resolution No. 12-081, the Animal Control Advisory
Board was established by the City of Port Arthur; and,
WHEREAS, the terms of the Animal Control Advisory Board shall be for two
years; and,
WHEREAS, pursuant to Resolution No. 12-081, it is necessary to fill the expired
terms for the Animal Control Advisory Board; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Council of the City of Port Arthur hereby appoints the
following members to the Animal Control Advisory Board:
1. Dr. David R. Webb, DVM — Licensed Veterinarian
2. Darlene Thomas-Pierre — Municipal Official

3. Anthony Mitchell — Animal Control Supervisor
4. Deborah Verrett—Animal Welfare Representative
Section 3. That the appointees shall immediately contact the City Secretary's
Office and be sworn in.
Section 4. That the terms of the Animal Control Advisory Board shall be for two
years, expiring on March 30, 2025.
Section 5. That this Resolution shall be effective immediately.
Section 6. That a copy of the caption of this Resolution be spread upon the
Minutes of the City Council.
READ, ADOPTED AND APPROVED on this day of March, A.D., 2023,

EXHIBIT "A"
Sec. 823. 005 . ADVISORY COMMITTEE. (a) The governing body
of a county or municipality in which an animal shelter is
located shall appoint an advisory committee to assist in
complying with the requirements of this chapter.
(b) The advisory committee must be composed of at least
one licensed veterinarian, one county or municipal official, one
person whose duties include the daily operation of an animal
shelter, and one representative from an animal welfare
organization.
(c) The advisory committee shall meet at least three times
a year.
