"Bob"Bowers Civic Center To: The Honorable Mayor and City Council Through: Ron Burton, City Manager From: Adam J Saunders,Civic Center Dir RE: Proposed Resolution No. 22564 At Rosehill Manor, much repair and maintenance are needed. The City Council approved Resolution No. 20-200 in June of 2020, along with three change orders, for Phase II repairs. Phase II work is complete and the retainage of$13,187.50 has been requested by American Restoration LLC of Wylie, Texas who have submitted close out documents for this request. ANALYSIS/CONSIDERATION: There are a lot of needed repairs at the building. Phase II work is complete. The contractor, American Restoration LLC of Wylie, Texas, has submitted close out documents for the release of retainage for Phase II repairs and renovations to Rosehill Manor in the amount of$13,187.50. RECOMMENDATION A resolution authorizing the City Manager to accept close out documents submitted by American Restoration LLC of Wylie,Texas and approve the release of retainage in the amount of$13,187.50 for Phase II repairs and renovations to Rosehill Manor. Funding is available in Hurricane Account#140-00- 000-2050-00-00-000. BUDGETARY AND FISCAL EFFECT Funds are available in account#140-00-000-2050-00-00-000 STAFFING EFFECT None P.R. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ACCEPT CLOSE OUT DOCUMENTS SUBMITTED BY AMERICAN RESTORATION LLC OF WYLIE, TEXAS AND APPROVE THE RELEASE OF RETAINAGE IN THE AMOUNT OF $13,187.50 FOR PHASE II REPAIRS AND RENOVATIONS TO ROSEHILL MANOR; FUNDING IS AVAILABLE IN ACCOUNT #140-00-000-2050-00-00-000. WHEREAS, pursuant to Resolution No. 20-200 on June 23, 2020, the City of Port Arthur City Council awarded a contract for Phase II repairs to Rosehill Manor to American Restoration LLC of Wylie, Texas for the amount of$211,000.00; and WHEREAS, the City Council approved Resolution No. 20-470 on December 22, 2020, for Change Order No. 1 for Phase II repairs to the Rosehill Manor increasing the contract term by four days; and WHEREAS, the City Council approved Resolution No. 20-471 on December 22, 2020, for Change Order No. 2 for Phase II repairs to the Rosehill Manor in the amount of$50,100.00, bringing the total of the contract to $261,100.00; and WHEREAS, the City Council approved Resolution No. 21-146 on April 13, 2021, for Change Order No. 3 for Phase II repairs at the Rosehill Manor in the amount of$2,550.00 to a new total of$263,650.00 WHEREAS, American Restoration LLC of Wylie, Texas has submitted the Certificate of Substantial Completion dated September 8, 2022 and the work to which the Certificate applies has been inspected, authorized, and declared to be complete in accordance with the contract documents and made a part hereof as Exhibit A; together with the Contractor' s Certificate and Release (Exhibit B), the Contractor' s Certificate of Warranty( Exhibit C); and, WHEREAS, the retainage for the project is 5% of the work completed and billed, the Release of Retainage has been submitted by American Restoration LLC of Wylie, Texas, for the amount of$13,187.50, see Exhibit D; and, WHEREAS, American Restoration LLC of Wylie, Texas, has completed the contracted project to the satisfaction of the Civic Center staff and LaBiche Architectural Group, see Exhibit E; and, WHEREAS, approval of the acceptance of the Close Out Documents, and Release of Retainage is herein deemed an appropriate action; now,therefore, P.R.
