Contracts with Eighteen (18) vendors on a Rotation Basis for the Mowing of Privately-
owned and City-owned Vacant and Developed Lots in an Area of the City Designated as
Areas B-E.
Recommendation:
Staff recommends that the City Council adopt P. R.No. 23049, authorizing the second-year(first
renewal)of the contracts with eighteen (18)vendors for the mowing of privately-owned and city-
owned residential and commercial vacant and developed lots in Area B-E. The contractors are:

contractor has demonstrated that they are qualified and capable to perform mowing services in
Areas B-E.

Background:
The eighteen (18) contracts were approved by Resolution No. 22-190 on April 26, 2022; The
vendors have been providing quality service and have met the terms of their contracts with the
City. The vendor's response and services have been commendable. One (1) contract will not be
renewed for failure to meet contractual obligations. These contracts are necessary due to an
abundance of high grass in Port Arthur, and the Environmental Health Division needs multiple
vendors to maintain each area. Below is the order of rotation for the vendors.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE SECOND-YEAR (FIRST RENEWAL)
OF CONTRACTS BETWEEN THE CITY OF PORT ARTHUR AND EIGHTEEN
(18) VENDORS FOR GRASS MOWING SERVICES OF PRIVATELY-OWNED
AND CITY-OWNED VACANT&DEVELOPED LOTS IN AREAS OF THE CITY
DESIGNATED AS AREAS B-E, WITH AN ANNUAL PROJECTED
BUDGETARY IMPACT OF $200,000.00. FUNDS ARE AVAILABLE IN
GENERAL FUND ACCOUNT NUMBER 001-13-039-5470-00-50-000.
WHEREAS,there are a large amount of properties that the City maintains by mowing the
grass, due to the lack of care by the owners; and
WHEREAS, multiple contractors are needed for each area due to the volume; and
WHEREAS,the City Council initially awarded nineteen(19)contracts on April 26,2022,
pursuant to Resolution No. 22-190; and
WHEREAS, Ruben Torres Landscaping of Port Arthur, TX did not sign the initial
contract; and
WHEREAS,the order of rotation is attached hereto as Exhibit"A"; and
WHEREAS,the City Council deems in the best interest of the City to renew the existing
contracts with eighteen(18)vendors; and
'WHEREAS,this will be the second year(first renewal) of the eighteen contracts attached
hereto as Exhibit B-S, including an option to renew each contract for one (1) additional year.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That,the facts and opinions in the preamble are true and correct.
Section 2. That, for the purposes of this Resolution, Area B is bordered to the west by
Foley Street and to the east by Austin Avenue, its southern border is Procter Street,and its northern

border is Zwolle Road.Area C is bordered to the west by Austin Avenue,to the east by Woodworth
Boulevard(Memorial Boulevard),to the south by Lakeshore Drive, and to the north by 25th Street.
Area D is bordered to the west by Woodworth and to the eastward boundary of the City, the
southern boundary is Lakeshore Drive, and the northern boundary is 25th Street (Griffing Drive).
Area E is bordered to the south by 25th Street and its northern border is Aero Drive, its western
border is Memorial Boulevard and its eastern border is Jefferson Drive (Twin City Highway).
Section 3. That,the City Manager is hereby authorized to execute, on behalf of the City of

THIS AGREEMENT,made this of ,2023,by and between the City of Port
Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called
"OWNER"or"CITY"and J B CUTS,herein acting individual,firm,partnership or corporation
by and through Deadra L. Cheatham, hereinafter called"CONTRACTOR"
WITNESSETH: That for and in consideration of the payment terms, conditions. and agreements
set forth herein, OWNER and CONTRACTOR agree as follows:
1. Pursuant to Resolution No.22-190,the City entered into a one(1)year contract with the option
to renew for two (2)additional one-year periods. The parties agree to exercise said option for
the second year(first renewal). The City can terminate this contract at its convenience, which
includes,but is not limited to, funding not being available in any budget cycle with thirty(30)
days written notice.
2. Mowing assignments will be given to the contractor with the lowest contract price that is

4. During the term of this Contract, the Contractor will furnish, at his own expense, all of the
materials, supplies, tools, equipment, labor, and other services necessary to connection
therewith, except those supplies specifically not required of Contractor in the Specifications.
5. The CONTRACTOR agrees to perform all the work described in the specifications and
contract documents and to comply with the terms therein for the following cost: $0.0041 per
square foot.
