NO. 23090 — A resolution calling for a public hearing to consider a zoning change Introduction: The Port Arthur City Council is being asked to approve Proposed Resolution No. 23090, calling for a public hearing to consider granting a zoning change for approximately 1.924-acres of land, part of Lot 4, Block 7, Port Acres Addition (6194 Jade Avenue), Port Arthur, Jefferson County, Texas. The request aims to change the zoning from Commercial Retail "CR" (formerly referred to as Light Commercial "LC" district) to a Low-Density Residential (LDR) District (formerly referred to as Single-Family Residential District) to allow for the development of low-density residential (i.e., single-family) homes. Background: On or around March 10, 2023, Luis Espinoza, the owner of 6194 Jade Avenue, applied for a zoning change from Commercial Retail "CR" (formerly referred to as Light Commercial "LC" district) to a Low-Density Residential (LDR) District (formerly referred to as Single-Family Residential District) to allow for the development of low-density residential (i.e., single-family) homes. Per Appendix A, Section 3: Land Uses, providing an effective date of January 1, 2023, a "Single Family Dwelling" is prohibited in a Commercial Retail (CR) District. "Remember, we are here to serve the Citizens of Port Arthur" P.O.Box 1089 X Port Arthur,Texas 77641-1089 X 409.983.8101 X FAX 409.982.6743 Per Appendix A, Section 6.03 of the City of Port Arthur Zoning Ordinance, any person or corporation having a proprietary interest in any property may petition the City Council for a change or amendment to the provisions of this ordinance. The Planning and Zoning Commission may, on its own motion or on request from the City Council, institute study and proposal for changes and amendments in the public interest. A public hearing shall be held by the City Council before adopting any proposed amendment, supplement, or change. Before the fifteenth (15th) day before the date of the City Council hearing, notice of the time and place of the hearing for any zoning amendment (i.e., a Rezoning or a Zoning Text Amendment) must be published in an official newspaper or a newspaper of general circulation in the City stating the time and place of such hearing. The City Council hearing may be conducted as a joint hearing with the Planning and Zoning Commission in accordance with the provisions of Local Government Code Section 211.007. The Planning & Zoning Commission will conduct a public hearing on April 17, 2023. Budget Impact: None Recommendation: It is recommended that City Council approve P.R. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER GRANTING A ZONING CHANGE FOR APPROXIMATELY 1.924-ACRES OF LAND PART OF LOT 4, BLOCK 7, PORT ACRES ADDITION (6194 JADE AVENUE), PORT ARTHUR, JEFFERSON COUNTY, TEXAS Z23-03 (LUIS ESPINOZA) WHEREAS, it is being requested that City Council consider granting a zoning change for the area delineated in Exhibit "A"; and, WHEREAS pursuant to Chapter 211 in the Texas Local Government Code, a public hearing must precede any zoning change. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the facts and opinions in the preamble are true and correct. THAT the Planning and Zoning Commission will review the case on April 17, 2023. THAT a public hearing to consider whether to grant the zoning change for approximately 1.924-acres of land part of Lot 4, Block 7, Port Acres Addition (6194 Jade Avenue), Port Arthur, Jefferson County, Texas, as delineated in Exhibit "A" shall be held on May 9, 2023, at 6:00 p.m. in the City Council Chambers, Fifth Floor, City Hall, 444 4th Street, or by telephonic and videoconference. THAT notice of the public hearing shall be published at least fifteen days prior in the City's official newspaper before going to the City Council. THAT a copy of the caption of this Resolution is spread upon the Minutes of the City Council.
