RESOLUTION NO.
A RESOLUTION APPOINTING MEMBERS TO THE NEGOTIATING
TEAM PURSUANT TO CHAPTER 174 OF THE TEXAS LOCAL
GOVERNMENT CODE, TO CONDUCT COLLECTIVE BARGAINING
WITH THE BARGAINING AGENT OF THE PORT ARTHUR FIRE
FIGHTERS, INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS,
LOCAL 397
•
WHEREAS, the City Manager received a letter correspondence dated March 30, 2023
from the Port Arthur Fire Fighters, IAFF Local No. 397 regarding the request to begin collective
bargaining negotiations for fiscal year 2023/2024; and
WHEREAS, pursuant §174.106 of the Texas Local Government Code, a public
employer, (i.e., City of Port Arthur) or an association may designate one or more persons to
negotiate or bargain on its behalf.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
THAT,the facts and opinions in the preamble are true and correct.
THAT, pursuant to Chapter 174 of the Texas Local Government Code Annotated, the
following persons are hereby designated to conduct collective bargaining on behalf of the City of
Port Arthur with representatives of the Port Arthur Fire Fighters, IAFF Local No. 397.
THAT, the City Council hereby designate the following persons to negotiate on its
behalf: City Manager, Director of Human Resources, Director of Finance, Fire Chief, and
City Attorney.
THAT,the City Manager is hereby authorized to designate a chief spokesperson.
THAT, the City Manager is also hereby authorized to provide a suitable place for the
collective bargaining sessions, and to provide such supporting City personnel as needed by the
City negotiating team.
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.

RE: Collective Bargaining
Dear Mr. Burton,
Consistent with the provisions of The Texas Fire and Police Employees Relation Act,T.I.G.C.
Chapter 174 Sub Chapter 174.10, and Article 3 of our current labor agreement, please be
advised by this correspondence of our intent and request for Collective Bargaining for
upcoming fiscal year 2023/2024.
Under the statue provisions we the parties have an obligation to meet at a reasonable time and
bargain in good faith, we therefore respectfully request that at your earliest convenience,you
notify us of available dates for such purpose.
It is our hope that now as in the past we will, through good faith negotiations, reach a
successful and mutually beneficial agreement.
