Introduction: The intent of this Agenda Item is to request the City Council's approval of P.R. No. 23105 authorizing the City Manager to purchase 20 custom picnic tables from Commercial Site Furnishings in the not-to-exceed amount of$25,00.00. Commercial Site Furnishings is the sole manufacturer of this particular picnic table. This procurement is exempt from the bid process under Texas Local Government Code Section 252.022, General Exemptions (a) (7) (A), items that are available from only one source because of patents, copyrights, secret processes, or natural monopolies. Background: The Pleasure Island Department currently has aged concrete picnic tables throughout its parks. The purchase of picnic tables is needed to replace the tables in both parks for continued use by citizens and tourists. The Pleasure Island Department would like to purchase twenty picnic tables in an effort to beautify Pleasure Island. Budget Impact: There will be a budgetary impact of$25,000.00 for this purchase in account No. 307-60-000- 8525-00-00-000, Project No. PI004.CON. Recommendation: It is recommended that the City Council approve P.R.No. 23105 authorizing the City Manager through the Pleasure Island Department to purchase 20 custom picnic tables from Commercial Site Furnishings in the not-to-exceed amount of$25,00.00. FUNDING IS AVAILABLE IN ACCOUNT 307-60-000- 8525-00-00-000 PROJECT NUMBER PI004.CON WHEREAS, The Pleasure Island Department currently has aged concrete picnic tables throughout its parks that need replacing for continued use by citizens and tourists; and, WHEREAS, the Pleasure Island Department has requested to purchase picnic tables in an effort to beautify Pleasure Island; and, WHEREAS, a quote was received from Commercial Site Furnishings of Montgomery, Alabama for the purchase of 10 Model CF-076-LSRFG and 10 Model CF-076- HZYSQ custom perforated metal single-post square picnic tables in the total amount not to exceed $25,000.00;and, WHEREAS, Commercial Site Furnishings submitted a letter correspondence stating that the company is the sole manufacturer of this particular product delineated in Exhibit "A"; and, WHEREAS, this procurement is exempt from the bid process under Texas Local Government Code Section 252.022, General Exemptions (a) (7) (A), items that are available from only one source because of patents, copyrights, secret processes, or natural monopolies; now,therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1.
