Williams, Director of Human Re RE: A Resolution Approving a Property Damage Settle ent in the Amount of$129,730.00 for Damages to a City of Port Arthur Traffic Cabinet(Gulfway Drive and Bluebonnet) Nature of the request: On December 4, 2020, a citizen failed to drive in a single lane, left the roadway and struck an electrical pole causing it to break in half. The impact caused damage to the city's traffic control box and the components associated with the signal light. Texas Municipal League Intergovernmental Risk Pool (TMLIRP) has previously issued payment in the amount of$129,730.00 for the damages to the traffic signal; therefore, this payment will be in addition to the previous settlement from Texas Municipal League Intergovernmental Risk Pool (TMLIRP). Staff Analysis, Considerations: The City of Port Arthur has Physical Damage insurance coverage through Texas Municipal League Intergovernmental Risk Pool (TMLIRP). TMLIRP has offered the City an additional settlement of $129,730.00 (Exhibit "A" attached). This amount will cover the remaining portion of the repairs to the estimated property damage to the traffic controller cabinet and signal. If additional damages are discovered, TMLIRP may issue a supplemental payment. Recommendation: I recommend approval of Proposed Resolution No. 23123 authorizing the property damage settlement against TMLIRP for damage sustained to the traffic controller cabinet. TMLIRP has offered an additional settlement amount of $129,730.00. This is considered a fair and reasonable settlement to cover the remaining portion of the repairs. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE SETTLEMENT OF A PHYSICAL DAMAGE CLAIM IN THE AMOUNT OF $129,730.00 MADE AGAINST TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TMLIRP) AS A RESULT OF PROPERTY DAMAGE TO A TRAFFIC SIGNAL ON GULFWAY DRIVE AND BLUEBONNET WHEREAS, on December 4, 2020, a citizen failed to drive in a signal lane, left the roadway, struck an electrical pole causing damage to an electrical pole; and, WHEREAS, as a result of the damage, a claim was filed with Texas Municipal League Intergovernmental Risk Pool (TMLIRP) for the cost of repairs; and, WHEREAS, TMLIRP has offered an additional settlement to incur the remaining repairs in the amount of $129,730.00, which is considered a fair and reasonable settlement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That, the facts and opinions in the preamble are true and correct. Section 2. That, the City Manager is hereby authorized to execute settlement in the amount of $129,730.00 for the remaining repairs to the traffic signal, for the claim against TMLIRP in substantially the same form as delineated in Exhibit "A". Section 3. That a copy of this Resolution be spread upon the minutes of the City Council.
